Guys,

Need some advise here. I have a friend who is married and illegal in the country with his wife and kids. His father was a US Citizen and had applied for his green card before he died and this was about 10 years ago. The son’s petition was approved but he never knew about this until now. Is there anyway for him to get his green card or can he do anything else to get legal.

I don't believe there is anything that can be done. The sponsor must continue to be the sponsor at the time of adjudication and this would not be the case since the father has passed away. So there is nothing he can do about this matter.
 
If his wife is a USC he can get a GC through her (despite being out of status). Tell him to talk to a lawyer.

Why dont you ask a lawyer? If the petition is approved, maybe he can do something for you. But being out of status(if he entered illegaly) may cause lots of problems.

Has this person worked and paid taxes in the United States for at least 10 years (40 Social Security credits)? If no, does he have a relative (who is a citizen or a legal resident) who can sign an affidavit of support for him?
