Good News for some WAC03 Applicants, but very Disappointed News for WAC02 Applicants

According to Project Kashmir,
the CSC had issued 226 RFEs to WAC03 applicants whose fingerprint will be expiring soon.
It looks good news for those WAC03 applicants.
Here is the summary table:
Code:
         WAC02 WAC03 TOTAL
----------^---^---^---
2004-03-11 7 111 118
2004-03-10 11 81 92
2004-03-09 10 33 43
2004-03-08 4 1 5
----------^---^---^---
     TOTAL 32 226 258
         12.4% 87.6%
On the other hand, the CSC has been almost ignoring WAC02 applicants for a long time.
For a instance, the number of RFE sent/recieved status for WAC02 cases filed in January, February, and March 2002 is only 88.
Most of WAC02 applicants should have been told that the CSC would not take any action for expiration of fingerprint.
If the CSC would continue such a discrimination to WAC02 applicants,
the CSC would issue RFE to another WAC03 applicants not to expire their fingerprints,
so WAC02 applicants would have no chance until FY2005 even if the CSC would allocate enough resource to I-485 process.

I encourage all WAC02 applicants to participate in the following three campaigns.

#11a - Don Neufeld
#11b - Congressperson and Senators
#11c - Others

RE: Stop Discrimination to Long-Waiting WAC02 Applicants

Dear Director Don Neufeld;

We confirmed the CSC had issued more than 200 RFEs
to WAC03 applicants not to expire their fingerprints.

On the other hand, the CSC has been almost ignoring WAC02 applicants for a long time.
Most of WAC02 applicants have been told that
the CSC would not take any action for expiration of fingerprint.

I don't want to see any single approval of WAC03 nor WAC04 cases
before my approval as one of WAC02 applicant waiting for over 2 years.
Please stop such a discrimination to long-waiting WAC02 applicants,
and focus adjudicating WAC02 cases.

Actually, I received a letter from HQ of CIS in last December
as a response to USCIS Director Eduardo Aguirre, and it described:
> Currently, the California Service Center is adjudicating
> employment-based applications which were filed on December 16, 2001.
> Nothing can be done, in the interest of FAIRNESS to those
> who applied before you did, to expedite the adjudication of your application.
Please show us your FAIRNESS to long-waiting WAC02 applicants.

Sincerely,

this Don guy is a jerk. he is not going to do anything. I am planing to file a writ of mandamus if I see significant number of WAC-03 approvals.

Could it be that guy's answer to our email/mail/fax campaigns?
I don't think we have any other choices than to keep fighting.

Email sent. Only changed the "I" in last paragraph of Kashmir's script to "A member of ImmigrationPortal".

E-mail sent. I changed the first paragraph:

After more than two long years of waiting I've decided
to write to you personally because California Service
Center (CSC) has for a long time been neglecting
Adjustment Of Status (I-485) applicants.
Lately there has been a disturbing trend especially
against applicants with receipt numbers beginning with
WAC-02.

Email Sent

Sent Email. Anyone knows how many months are the fingerprints valid. Is it 15 or 18 months?

Mail sent

FP is valid for 15 months, I did my 2nd fp 2 months ago, so looks like I need to wait for 13 more months for an RFE.

I think these RFE of the same trend as were last year when they had send out some random rfe's to wac02 .

And we thought it was good news for wac02 ppl and here we are in the rot.
OR this could be a idea of that ediot DON Nu to show ppl that they are looking in to wac03 cases and have reduced the time frame for 485.

Mine is WAC-03 and after knowing that RFE's were issued to this series of applicants, i checked my status and it did not change. I was pissed off that people whose applications came in after me are getting RFE's and i did not get it.

It instantaneously clicked me the plight of WAC-02 applicants. I too don't want to encourage this discrimation.

I just sent my email too...

Text of my email. Modified to an extent to reflect my opinion.

RE: Stop Discrimination to Long-Waiting WAC02 Applicants

Dear Director Don Neufeld;

We confirmed the CSC had issued more than 200 RFEs
to WAC03 applicants not to expire their fingerprints. We do not want to encourage any UNJUST practices by USCIS in processing the applications causing more anxiety and trauma to people who filed before and waiting for a long time to see their cases adjudicated. Applicants whose Finger prints have expired should not be penalized to wait for more time because of USCIS's processing delays.

Please stop such a discrimination to all long-awaiting applicants and process them in the order they were received. It is FAIR to one and all alike.

Sincerely,
<my name>.
