I finally got my asylum from judge on april 23 , 2007 after being in the country for over 7 years and waiting over 3 years for the final court hearing.
I want to know if it is still a law that I can apply got parmenent resident card only after being one year physically presense in the State? .

I was told to go to the INS office to get work permit card and other document maybe it is i94.

1/IT'S STILL A LAW THAT One YEAR has to be waited before I can file PR application?

2/What will be the validity period for the EAD or work permit card?

3/If I apply for PRC on april 24 , 2008, when will I receive my green card?

4/Can I travel outside the US while I am an asylee granted and I have not filed application for parmenent resident card or I have to stay in the US for one year after getting asylum and can not file for REFUGEE TRAVEL DOCUMENT before staying in the US for at least one year after getting asylum?

If you have any updates on these, pls answer me here.
I want to know how USCIS is doing for these case.
I dont wanan know opinion or update on lawsuit against the gov but final ruling or thigns that are happeining and being done by the uscis.

1/IT'S STILL A LAW THAT One YEAR has to be waited before I can file PR application?Yes. You still have to wait 1 year

2/What will be the validity period for the EAD or work permit card?Don't bother getting an EAD. It's just useless. It's only valid for one year and it cost a lot of money. Just go to Social Security office and getting a plain SS card (with no restrictions). You can use that to work. As an asylee you don't need an EAD anymore

3/If I apply for PRC on april 24 , 2008, when will I receive my green card?It depends. The USCIS website says that beginning this year, it should only take 6 months to get a GC, but I don't know if they are going to follow their timeline. You just have to wait and see. It seems that they are processing newer cases faster, so it might really happen!

4/Can I travel outside the US while I am an asylee granted and I have not filed application for parmenent resident card or I have to stay in the US for one year after getting asylum and can not file for REFUGEE TRAVEL DOCUMENT before staying in the US for at least one year after getting asylum? You can travel with a valid RTD. But make sure you don't stay out for more than a year.

If you have any updates on these, pls answer me here.

I dont know if u r correct that I can travel outside the US with RTD before being physically present in the US for one full year after obtaining asylum.
The law is saying that I have to be present in the US for one full year after getting asylum.
It is also saying asylum grantee can travel outside the US with valid RTD.
Any contradictions?
I can apply and travel outside the US with RTD only after having physically present in the US for one year?

MGTgrl is correct, once you get your asylum approved you can request the travel document at any time, the 1 year physical presence you are confusing is to apply for the green card, also the travel document is valid for 1 year.
Where did you find the law you are talking about? I have never heard about such law maybe is a new thing?

i know one year presense after the grant of asylum is to be eligeble to apply for green card but if I travel out side with RTD before the one year stay, I can't apply for GC after the first year and that maybe a problem to apply for GC.

RIGHT????????

It's wrong...you can still travell.

You can travel out side the US the next day you get your asylum granted with a Refugee Travel Document. The thing is you can't be out side USA for more than 6 months, because it will start counting against your one year permanent resident.

I travel outside US more than 6 times while been an asyle, and now I'm a permanent resident.
You wouldn't have ant trouble.

Ok then what it means by, you have to be physically present in the US for one year beofre you can apply for GC?

Travelling before one year presense in US and you have to be phisically present in US for one year after you were granted asylum and before you can apply gor GC, THAT IS WHAT LAW REQUIRES as I read it on USCIS website.
It contradicts with what you guys are saying.

Maybe it doesn't and I am wrong but tell me me facts .
thanks

Mr. Action6: you are mixing some different issues into one issue. The requirements that refugees and asylees to be present in the country for 1 year before they can apply for greencard. For example, in your case in order for you to apply for greencard you must wait for 1 year and then apply. For example, if your asylum is approved in March 2007, then you are eligible to apply for greencard in March 2008. You can not apply for greencard in February 2008. That is one law and it has to with moving from I-94 to greencard.

Another question is when can an asylee travel after grant of asylum? In other words is there a time limit on when asylees can travel after they are granted asylum. This requires differentiation from asylees whose status were issued outside of the country as derivatives and those whose status are issued within the country. For those whose status where issued outside of the US, is have seen advices that they stay in the country for one year before they travel. Exceptions are made if there are emergencies. Common sense will also dictate that it won’t make sense for an asylee to arrive the country and to travel the next month.

As far those whose status where issued within the United States, I don’t know what would mean. I think if you want to travel, you will need refugee travel document; and if you apply for it and the UCIS issues you one, then you will have no problem. Otherwise, if there is time limitation, they will tell you that you are not eligible…good luck

You have to be physically present in country for 1 year. So if you travel for 8 days, you will add 8 days to the day you were supposed to apply for your Green Card....etc.

it sounds like it is best if I stay physically here in the States for one full year that is untill april 23 of 2008. As I mentioned before that my asylum grant from the judge was on april 23 2007.
I will then apply for travel document and GC at the same time.

Action6:
Does it realy sounds like that? I think you are wrong, I think what everybody is trying to tell you is the opposit. But do as you wish, each person owns their fears and we are free to do as we pleased.
Good luck.

You can travel at any time after the grant of asylum but you can file a green card application only after you have lived here for one year after the grant. The time you spend abroad will be subtracted from the one year.

Example A: You are granted asylum in January 2007 and you do not travel then you apply for your green card in January 2008.

Example B: You are granted asylum in January 2007 and you visited Canada in March to April 2007. Then you apply for your green card in February 2008.

To the extent that you travel abroad within one year of the asylum grant you delay your green card eligibility date.

Does that help?

Who said so? If you have been away for one month it means you missed it?
