GC for brother and sister

Folks, I a new US Citizen and want to sponsor my brother and sister for GC. Below is their scenario:

1. Brother: He is in US on F1 visa doing PhD. India's Employment based green card system is so badly messed up that there may not be any hope for him in EB2 category. To prove EB1 or NIW is also very hard. If I sponsor him for GC then what do I need to do - and what documentation is required? Any help will be appreciated greatly.

2. Sister: She is in India and I'm sure will not get Visitor's visa because of her young age etc so I'm not even thinking to sponsor her for B1/B2. I would however like to sponsor her for GC so she may have an option can come to US 10-15 years later if need be. What documentation and form is required for this purpose?

Just to give you an idea, the priority date wait for FB4 India is NINE YEARS longer than EB2 Inidia.

What documentation and form is required for this purpose?

The form is the I-130. The instructions will tell you what you need to file with it,.

Hi Canadian. Thx. I read instructions about I-130 for sister. Looks straight forward. Is is possible that in future she tries to get visit visa to US and her I-130 has already been approved then they will deny her visa or will she have any problem at airport even if she gets visa?

Also, regarding my brother, I think the EB2 India is about to go to ancient times becoz all Eb3 guys are moving to eb2. You should read what is going on this front at www.immigrationvoice.org This website is very active in this area. They are saying that there may be 100s of 1000s of Indians pending under eb2 very soon. PhD can try to get eb1 but that is not easy to prove. If eb2 gets clogged heavily then I think family based gc could turn out to be faster than eb2 india. If I do file his I-130 is there any issue with his travelling in and out of US and is there any impact on his F1 and then H1 and then maybe another sepearate eb1/eb2 petition. I want to know whether filing family based petition has any kind of negative impact on anything else?

Unless they're all getting new LCs and new I-140s, they cannot switch categories upwards. Either way, I don't see FB4 ever getting quicker than an EB category.

I am no longer an Alian. I am a US citizen now and live here in earth, but I want to sponser my Alian brother. I understand it may take several years. My question is that should I file I-130 for him now and wait until his case get approved and then his wife and kids automatically get the green card or should I file for each of them at this time.

Can someone tell me, what stages there are and what forms should I file.

Sorry folks, I have to move this thread to top because my original question regarding my brother is still not clearing my doubt. He is currently on F1 visa, and if I file his I-130 in F4 category then does that have any impact on his travel in and out of US on F1 and then later H1 visa? Also if he files EB petition later thru future employer then will that have any impact on travel and his GC petition both Eb and FB?

Please clarify. Thanks very much.
 
yes, it does. Once you file I-130 for him, it will become very difficult for him to prove non-immigrant intent if travelling/getting F-1 visa.

It will NOT have effect on H-1 visa or his other GC petitions.
