Hello all

I am a physician and had my EB1 based GC approval from Texas service center on 13th July 2009. I was in India last week meeting prospective brides in hope of getting married before the I485 approval. Now with this new complication, I am not sure what my options would be. I would be marrying her early next month. My EB1 application date is July 7, 2008.
If I do proceed with the plans of marriage:-
* does my wife stay in India for years, as mentioned in numerous sites, or based on my EB1 application she gets a priority too?
* If she does get to stay in India and myelf here, then what are the other options I have?

I appreciate your help... especially ASAP :) looking at the timelines I have.

She either has to wait for 4-5 years or try to get an H-1B/L-1 visa.

The only option for the wife to get the EB priority date is to show documentation like a marriage certificate that the marriage has occurred before the I-485 approval date.

By the way can you share some details on your GC processing under the EB-1 category. I have a brother who is also a physician planning to start GC processing. What type of eligibility is required to file under the Eb-1 status.

Which is a great way for both spouses to receive a lifetime bar from ever re-entering the US.

"Exceptional Ability" or being an "Outstanding Researcher".

There is one more option which could be the fastest way... abandoning GC, apply H1(and get her H4), then apply for EB1 again. Being able to have got approved under EB1, this approach shouldn't be that bad in terms of processing time and priority.
There are some risks, but it's a matter of your priority in life.
