Hey Guys. I've entered the US on F1 Visa but never went to college because of financial problems with my sponsor. At the same time my home country was politically unstable and I didn't want to go back. I came in 2002. Hence my status was violated. Right now I want to apply for Asylum status. What chances do you think I have? I really don't want to live like this no more. I can't leave the US right now because I won't be allowed to Re-enter !! I'm 23. I Need some valuable advice to adjust my status. Please help !!!
 
I have admit that the only valuable advice would be: 'go and consult the attorney'. I would suggest not to take any other advice from this forum or anywhere else.
 
First of all you have been in the US on F1 and have not being going to school. That is a minus point for you.

Second it will be hard for you to get asylum as you have already passed the 1 year bar unless you can convince the officer or the judge.

Third if your case is granted you will get witholding of removal unless you can convince the judge or the officer to give you asylum as per law you are suppose to apply for asylum within the 1st year of arrival in the US to be eligible for grant of asylum.

If you get witholding of removal you can not apply for green card or US citizenship.

So please think over what you need to do. I would suggest that you get married.

Unless you think you can convince the judge to give you asylum or if you are happy with witholding of removal.

I can confirm what Eddie_240 just said because a friend of mine was in the same situation. U can probably find a lawer who will take ur case and even promise u good results but I would say that ur chances are very small. Better get merried (but first fall in love :) ).

also you can try the dv-lottery for this year if your country of origine is permitted to participate, you have nothing to loose but you maybe lucky. never desperate, keep your faith. consulting a good aware lawyer would be a good idea too, he might suggest something else. good luck to u
 
Another advice

Even though you have stayed here longer than a year, I know that some people still were able to apply for asylum. They just needed to indicate good reasons why that was the case. Ask your lawyer is that applies to you.

Ask your LAWYER. Every case is individual because of the country and personal situation.

Coming in here as a student and never going to class is very very bad, especially in the post 9/11 world. This suggest visa fraud on your part. So even if your marry a citizen this will still be a huge potential problem for you. So I suggest you getting a good attorney.

I feel for you however none of the above justifies your absence from school. I don't know whether you are a male or a female, in any event you will have to answer some serious questions.

You have to evaluate your own situation, particularly you finances and seek some legal help. Make sure you don't get taken by any so-called Immigration Attorney. I don't want to scare you but you are "Out of Status". Do something good with your life. If there is anyway I can be 23 again, I'll do wonders.

Tried dv lottery twice already

yep, my country is pemitted for the DV lottery and I did try within the last two years, but to no avail. I'm trying all around to untangle the circle around me. thanks for the advice.
 
Yep, I know the consequences. Do you think I should pursue my studies at some private institution. Do u think that'll help? I'm 23 but nothing flies like time. Wanna clean up this mess b4 it's too late. thanks

You can get education at private institutions as you mentioned or even online colleges....You should pray for an amnesty or a guest worker program so you could be legal again...
 
DO NOT APPLY FOR THE DV Lottery!!

Under current law, a person who is in the U.S. without legal status who wins the DV lottery will not be permitted to apply for their residence from within the U.S. ("adjust status") unless they had some other legal permanent residence visa petition (family or employment based) filed before April 30, 2001. The DV lottery program is not an amnesty program.
If you are undocumented and you receive a notice from DOS that you have won, the notice will instruct you to return to your country for processing. If you follow these instructions and leave the U.S., you will almost certainly not be allowed to return to the U.S. Under current immigration law, anyone who has been in the U.S. without legal status for more than six months, will be prohibited from returning to the U.S. for three years if he or she leaves. Anyone who has been in the U.S. without legal status for more than one year will be prohibited from returning for ten years if he or she leaves.

There is a much greater risk for undocumented people to apply this year than there was in past years because the applicants’ information will all be gathered electronically. DOS has said that they will use this information as part of its fight against terrorism, it’s not clear whether the information will be used against undocumented immigrants.
While there is always hope that the law will change and people without lawful status will be permitted to adjust status from within the U.S., the risk of the information being used against an undocumented applicant seems greater than the likelihood that a successful undocumented immigrant could apply to adjust their status to legal permanent resident. If you are undocumented in the U.S. and thinking about applying for the DV lottery, you should consult with an experienced immigration attorney first and pray for an amnesty.
 
how long would i have to wait

Actually, my fiance is a US citizen. If we do get marry now, how long do u thing it'll take for me to get my work permit, SS and GC, considering what my situation is? I also want to pursue my studies at a private institution. Atleast that'll show that I still have interest in studying and upgrading myself despite my unfortunate circumstances previously. Any views in this regard?

I recall one of my friend's spouse came to the U.S, on a visit visa, over stayed and eventually got married to him.

Since she came with a visa, my friend was able to file for her. It took her over 3 years to get her GC. I'll try to ask my friend when did she arrive and what they do to adjust her status.
