from frustrated to confused

So I posted this a few weeks back :
So I contacted USCIS yesterday and did get some info. First I was told they were waiting on my name check to clear. Then I was told that they were waiting for my fingerprints. I told them that I did a service request months ago and was told that they were reusing my prints from I-751. The I.O. told me to hang on and I could her the I.O. typing away for a few minutes. Was then told that OK, they are reusing my prints and that actually I should get an interview appointment soon as my case was just assigned an officer late last week and to call back later this week for more info. I feel I am in purgatory. The past 2 times I called USCIS I was told that I was in the interview queue, no mention of fingerprints or anything. Once I clarified by saying to the I.O. "OK, so you're telling me that I am just waiting on an interview date to become available in Philadelphia?" and the I.O. said "yes". My patience is very thin. As soon as I reach the 5 month mark In a few weeks) I will be contacting my Congressman and the USCIS ombudsman. If I do get my interview letter before the 5 month mark then I won't contact them. At least yesterday I received some info instead of the usual canned response I usually receive. It seems that my name check is taking a long time. Would my case be assigned an officer if my name check wasn't complete?

Now I have just received the RFE! WTF! I called the 1800 and spoke to an I.O. and was told that yes they did decide to reuse your fingerprints back in August BUT it is their discretion if they want to make you do Biometrics. The person I spoke to on the 1800 no. confirmed that it was an appointment for my Biometrics. What can I do. Can I contact the USCIS ombudsman or a congressman? Or do I just wait it out? The person on the phone also told me that the time frame for citizenship is 6 months?

How old are your FPs from I-751? If they are older than 12-15 months, then you'll have to redo them no matter what.

Reusing the old FP was BS, I have never seen them reuse old FP.
Just go to your FP Appointment, seems like it's on track now.

Either way I need to do them again. My frustration is that I have been told different things. I had my prints done in August 2009. So I understand why they would want me to do them again as it has been 13 months since I last had them done but USCIS could at least be more cohesive with the info they have given me. Now at the 5 month mark I'm told to do my fingerprints.

When you applied, your previous FPs were still valid according to USCIS. During the process they realized your FPs would expire so they went ahead and had you take them again. Unfortunate, but that's the way USCIS works.

So I have already received the Yellow Letter ( over 2 months ago), so what happens now. I was close to an interview now I have to do Biometrics, does this mean that I have to wait (potentially) 5 more months? Or will they receive the Biometrics and schedule the interview? I previously stated that they said my name check is still pending, is that because of the fingerprints?

It depends on if your file has already been transfered to DO for imminent interview. If it has, then the new FP should not substantially delay the process further. However, if the file is on hold until the FP is completed then then interview will only occur once the FP and name check is complete.

Did vehar have to give his/her prints only because he/she hadn't had an interview, or would someone waiting for a decision for a long time after the interview need a new set of prints too?

No I'm not waiting for a decision. I was in the interview queue (ironically I received a response to my service request today dated 12/16 and it says I'm in a queue awaiting an appointment) and I'm assuming that when my case was assigned an officer a week or two ago they (USCIS) realized my prints were now out of date and they couldn't reuse them as they initially told me. So I don't know where I stand. If (as Bobsmyth said above) my case file is at my D.O. then hopefully after I have my prints done then I will receive an interview appointment if not then I guess I will continue this waiting game. Either way I'm outside of the 5 month processing time frame for my D.O.
