Forgiveness for an overstay?

Is this true or just a myth?

I came on a visa waiver married before it ran out and stayed..... I am about to send in all my forms and want to be sure we'll be ok for that part... does USCIS actually say this anywhere??

Also, does anyone know if I have to have the medical before I send in my forms... I will be doing 130 and 485 at the same time.....

No myth. If you are the spouse, minor child or parent of a US citizen, an overstay cannot be used to deny your I-485.
However, the overstay can cause one to be refused entry to the US if one travels outside the US before the green card is approved. Which would ultimately lead to a denial of the I-485.
 
So I definitely shouldn't be traveling outside the US at all then.... otherwise I should be fine.... right?

Thanks.... it gave me confidence looking at your footnote.... I am an out of status wife and am hoping everything will now go smoothly when I apply to adjust my status.... hopefully I will get my EAD and everything will go along as fast as you!

I believe the doctor has to give it to you in a sealed envelope then you send it in with all the rest of your paperwork.
 
I arrived January 2007 and it expired 3 months later.... so I am 2.5 years over.... we actually were going to get it all done while I was still in status.... but there were complications and are only getting to it now....

I just want it all sorted!
