Follow to join GC for the spouse

I got the following response and thought to share with u all

Thanks for sharing this with us. It's very helpful.

The question is for "Complete copy of principal applicant's passport with evidence of admission as Legal Permanent Resident", I didn't travel yet with my GC, but planning to travel during this month.

I think that's more for cases where the principal applicant did CP, and they want the I-551 stamp in the passport. If you can provide an attorney-certified copy of your GC and the I-485 approval notice, that should suffice. Not as many people get the I-551 passport stamp these days.

GC started but spouse is not in US for the last 1 1/2 years

Hi all,

I got my GC recently and my wife left the country for new baby and stayed there for 1 and 1/2 years. Now, I want to bring both of them here. Should I transfer my wife's case from AOS to CP?

My lawyer says "She should contact the local Embassy/Consulate and have them issue a "transmittal letter" to her. If so, what is the procedure for getting "transmittal letter".

I think AP can't be used since she is outside the country for more than a year.

Which one should I follow? Appreciate all your responses.

thanks.

I did apply for 824 last month and I got receipt notice. Yesterday, I got the mail from USCIS as Notice of request for evidence. It said " You checked box C requesting CIS to notify a U.S. consulate of your adjustment of status. Please provide the name, relationship, gender and date of birth of EACH of your immediate family members you want to include on the follow-to-join application. Include their foreign address and their foreign telephone number."

Can I just write the requested info in the word document and send along with the letter? Also asked to attach the supporting documents.

Also can I request for my parents too or not?? Just curious...

Awaiting the response?? Thank you.

Crazygal,

Please post any update on your case. I guess, this will be our case too if I go home to Phils.

I am on a derivative status (husband holds TN status). We're Canadians but I'm planning to go home to Phils until my husband becomes a permanent resident. His employer will be filing his GC in later part of 2008 while my daughter and myself will be leaving the US in April 2008. That said, we won't be in the US when his GC is filed. We thought about the "follow to join" route... so please update this post on your case so that we have information about the whole process and the time to process the application.

My other question is (for RealCanadian), if that will be our case, can my daughther and myself travel in/out of the US (as Canadians) pending the application for our GC? OR, would you just advise me to stay in the US unitl GC is filed for all of us?

Appreciate answers.

Hi Yogkc or others on this forum,

I am trying to do FTJ and follow I824 path for my wife.

I am from Iran so there is no US consulate there and as a result of that I have the option to try some other neighbors cosulates. How can I make sure which consulate won't ask for I-824 approval? Is there any limitation on whcih consulate I should apply?

My I824 should go to NSC which is 16 months retorogressed.

Many thanks

I am going thru same process. As TheRealCanadian said Mail I824 to Service cetner where your I485 was sent to and you don't need to use lawyers. If the consulate is Mumbai they won't ask for I-824 approval so it would be much faster than other consulate offices.

Good Luck
