Hi,

I am US citizen and want to apply for GC for my mother and younger brother(18 years old) who are currently in India.
I went to USCIS website and read the document related to I - 130. I clearly understood the process for the filing the GC for parents but I am still confuse on how to file for my brother who is under 21 years old.
I was expecting him to come with my mother as he is still under 21.

1) Do I need to file a separate petition for my brother?
2) I can understand that my mother would be immediate relative and there would be no visa category for her but what would be the case for my brother.
3) I may mistaken but most of the thread being discussed are for the siblings who are older than 21. I am looking for the filing process for my mother and brother ( 18 years old).

I would really appreciate your help on this.

Waiting for the reply in anticipation ...

Thanks and Regards,
Amit

A3: You can sponsor your brother right now. Your mother can also sponsor him after she gets her own GC and moves to the US. Both sponsorships will be independent of each other and may process in parallel.

Thanks for reply Mr. Ghori. I did read somewhere that child under 21 would be beneficiary's derivative and would be in same line. That means if the beneficiary gets a green card that her derivative would automatically get a green. Will it not be a case for my brother as he is still under 21 and considered as minor.

This is not the case for Immediate Relatives.
