Family based, F4, AOS interview

It's just to go over some basic personal facts and the individual's immigration history to confirm that the person is who they claim to be and qualifies for AOS. And to show the original documents to USCIS in case they want to see them (since only copies were submitted with the application).

However, for F4 AOS sometimes they approve the case and send the green card without an interview. In family based AOS cases, the interview is mandatory only for those based on marriage.

Hi I have a question . My PD was current last year in October (based on approved I 130) I failed to apply for f4 sibling Aos and then there was a retrogression. Will this affect me when I apply for aos when my PD becomes current next time?

If you are the direct beneficiary (i.e. your USC sibling filed the petition, not your parent's sibling), and you maintain legal immigration status throughout, this retrogression won't be a problem when your PD becomes current again.

However, if you overstayed or are a derivative beneficiary there are more ifs and buts involved.

I am the sibling of a USC and a 245(i) beneficiary...

Just out of curiosity, what visa are you on? Did you obtain it after the I-130 was filed? Just wondering since some people seem to think that it is impossible to get a non-immigrant visa with a pending I-130, and apparently you didn't have any problems.

Overstayed student visa... was allowed to apply for AOS under section 245(i) PD became current but was not able to apply during the time when I could. Now I am in this interminable waiting period.
