It has been a long wait but I am glad
It's over now. Received my GC last week.
Verbal approval 10/2021

as you have been amazing. It helped me keep faith by readng individual experience.
All I would say, once granted, keep calling infopass for updates about your file. Some of them are very helpful. Don't wait for your lawyer to act, do it yourself if possible. Normally, it shouldn't take more than 60 days after the grant.
Good luck to those who are waiting. Just be patient. We are all God sons.

I would consult with a attorney, if your attorney is not available it might worth to get a opinion from another attorney.
Here’s what I think based on some things I heard before.
1- If the judge has already granted cancellation and you’re just waiting on the granted letter, it may be faster to stay on this route. Your granted letter should be in the next fiscal year, that starts in October.
2-If you’re still in removal proceedings, you typically can’t just file an I-485 through USCIS based on your I-130, unless your case is terminated or administratively closed by the immigration court. You may ask your attorney to file a motion to terminate proceedings based on the approved I-130, then adjust via USCIS. However this is wild card considering the latest with the current administration.
Hopefully you can get in touch with a attorney and be able to clarify, my suggestion is to not take any action without a legal advice.

As per my situation nothing has changed. I still cannot decide. My lawyer is asking me to be patient and wait for the grant letter because it might take longer to have the case terminated.
Other lawyers that I consulted are asking me for an average fee of $8,000 to have the 42B terminate and adjust my status.
I promised to get back with an update, so this is my situation.
I know some of us from Newark Court have been granted recently. If they could tell me when they were verbally approved and when they got their letters that could really help me.

Hi @Lolita07306 I am from Newark too. I got granted 04/10/25 and still waiting for the change of status. I still have the “fingerprint received” status on the uscis case tracker. I called them when I got granted and was told to wait 45 days. I reached out after 45 days and they referred my case to the Newark field office. Newark field office sent me an email after a week that they are still processing my case and they will mail the decision. So right now I’m just waiting.

When were you granted?

On the other side, my I-130 is approved but the lawyers are asking for too much money to have the 42b terminated and then move on to Adjustment of status

oh, did they tell you how long it will take to go about with the process of terminating it and then adjusting your status through I-130? I’m not sure if anyone else from Newark was granted after me but hopefully it moved so you’ll be closer when the new visa numbers come.

Honestly I would wait you should be granted no later then March of next year coming up, just because East Coast takes a bit longer. By the time the submit the application and get a court to terminate probably take the same time.

The lawyer said it might take a year for the judge to respond. I really don’t believe bit I don’t want to take a chance either.
So I will wait a bit to see if we’ll witness more grant letters in the coming weeks or so

Do I still need to have a court date? The judge should be able to terminate without a court date. Specially when I was done with everything. The procedure is not complicated but lawyers now are using the situation we living in to try to scare us and make more money out of it

Hi,
My opinion is you have to wait for your grant letter. My lawyer got a letter from EOIR on Jan this year its saying they Adjudicating 2021 cases.Thats means we are almost there at the edge. I am also 5/2022 NY.Hopefully we are all receive good News end of this year.
 
Hello all I hope everyone is as best as you can be. So I guess if we dont start seeing any news within these next 3 weeks then its going to be until October right? Its rough out here man.
October is coming soon!!! I hope by Christmas all 2021 and 1/2 of 2022 will be processed so a lot of us can spend some time home with our families. We are almost there!!!!!
