Entering without inspection

Hi,

I came as a Canadian citizen on B2 tourist visa and I was not issued a form I 94 Record of Arrival. I am filing for a permanent residence based on Relative petition.

Do I need to apply for I 94 now that I am applying for a permanent residence in US? Please help.

Just because you don't have an I-94 doesn't mean you weren't inspected. If you were admitted by a CBP officer, you were inspected. Just include a notarized statement that you were admitted on such and such a date and your place of entry. This is a common situation.

In the meantime, I did find out that, just like you said - just because I was not issued I 94, doesn't mean I entered without inspection. I was asked the usual questions by the Immigration Officer (How long are you staying, what address are you staying at...) which means I was inspected...
I am filing without the form I 94; I have a stamp in the passport...

I used to live near the Canadian border years ago, and some times I wasn't even ask for documentation at the border. I always had documentation available. I would not even attempt that now due to the Western Hemisphere Travel requirement.
