First, I got an ANSWER from AILA. The ONLY one that I know of.
Second, I got an ANSWER from MPI's Co-director who incidently spoke with USCIS Director in Canada about the Backlog problem.
Third, I posted in a newspaper when people were dying out of fear of a backlash.
Fourth, the most important of all I EDUCATED people like you with my posts. I have seen results in this respect also.
Finally, I am doing things that need no posts and congratulations. My biggest success would be if enough people woke up and realize that they indeed have CIVIL rights (if you do not like human rights). Only then they could help not themselves but the whole immigrant community in general.
Now, it is apparent who is bitching about all. Study the laws first, your rights, the immigration history, the Congress and come back loaded. Right now you are not. I would not even bet a vote on you on these issues because as I said your statements are simply wrong. How are we going to educate Congress if we ourselves do not get it right?
How can one fight for his/her civil rights when he/she believes they do not exist? How can one fight for a Backlog reduction, when the laws are there but still the belief is that the US Government gives GCs on a charity basis? THESE ARE THE ISSUES AT THE HEART OF THE PROBLEM.

It's not going to be an easier Lawsuit. It's going to be tough for both parties. We will have a tough time because we don't have a right for speedier processing or we will be hard pressed when USCIS says that they can't help unless they get more funds. But we are also going to put them in a tight spot by exposing their bad working style, lack of sensitivity, lack of urgency, lack of proper procedures, shifting manpower from I485 line, poor customer service, failure to do what the congress has asked it to do (through backlog reduction bill), increasingly worse backlog situation, failure to respond to our petitions, failure to come out with a clear action plan(failure to implement an action plan if they have one), giving false excuses (lying) for I485 delays because the main reason is their negligence whereas they blame funds, security issues etc. There will be several other arguments which support that the main cause of the backlog is the inefficiency of USCIS. Do you think the USCIS does not know this ? I bet they do and i am sure they will come down begging for a settlement. What i mean is we are in a much stronger position than the USCIS in this legal battle.
We will ask the court to pass orders to USCIS regarding certain change of procedures, come out with an action plan to process all backlog cases within 6 months etc. We can work out the details.
I am very confident that courts can ask the DOH to allott enough money for this cause.
One flaw in your argument (don't get mad :p) is that you are buying DOH argument that need for enforcing security is affecting it's other duties. We are not buying that. We are saying that the government / DOH /USCIS has completely neglected us and they should not get away with what ever excuses. We should not allow them to violate our civil rights (right to justice or what ever that is) . Regarding your observations about cuts for education in CA, that is due to poor economy, not due to diverting the money for Security.

The Administration derives its powers of governance from the PEOPLE! (read voters). They are supposed to reflect the will of the people. And its handling of the budget is absolutely inviolate!

Dictation of the Judiciary to the Administration branch to the extant of writing the budget is called interference and will never fly. They only thing the judiciary can do is enforce laws that are passed by the legislative branch. And that too only to the extant of resources available to the adminstration at that time.

It is not a case of the courts believing there is no money. It is a case of the courts believing that there is only 'X' amount of money, for which there are some projects that have high priority and others that don't. It is our badluck that we are on a low priority queue right now.

And if Cinta is so sure about the outcome of his legal beliefs and so fervent about its success, why doesn't he file a law suit based on it? He can spout the same laws to the judge and let us see where it takes us. I don't mind contributing some money to that cause. Instead we have to hear these theatric lines and constant dose of bitter aggression. Any person who opposes his views gets a steady dose of pent up agro and flamed.

Again, the lawsuit against INS has been filed in the AM today, I hope Rajiv will update all of us on it, we will have some genuine legal guidance upon what counts of law we can stand on. So this entire conversation is moot unless Cinta stands up for his civil rights and sues the INS! Until then let us end this useless waste of bandwidth because it is definitely taking us no where!

As far as myself filing a lawsuit, I can do it whenever and whereever I wish against whoever I perceive as responsible and that is my business only. And for what I did so far I PAID A PRICE, wise. You do not seem to get it and continue your disservice. Educate yourself, come with arguments and show these to your Congressman instead of believing their lies. I am sure you are not a TPS, Religious, Asylee, or illegal. All these they proved to be smarter and more knowledgable. But my theory is that it maybe in the DNA. You either have it or NOT. It is difficult to persuade.

It has been really an uphill battle from the beginning. I said it many times, we need a smart team, no sleeping cells, people with guts to do things. In this pursue, we will expose any inaccuracies, we will tell the truth, we will show the way by example. I am glad with your follow up guidelines. I have been pointing all these for a year and people were taking all different wise positions! Let the truth and justice SHINE!

Now that the lawsuit has been filed, it makes sense to advertise this in the media and gather support from lawfirms and potential immigrants. Here is where you can lead, since you have been involved in the petition campaign from the beginning.

We have been patient to educate and explain and show the right way, because we lived it, we experienced it. Still some are unconvinced or have their own genetic fears I would say. Nothing we can do to change that but it is our obligation to stop it before it actually damages what we have been trying to do in a noble way. People like to resort to name calling instead! Maybe you should tell them that they have CIVIL RIGHTS, that it is the Government's responsibility to give us the GC, it is not a charity in anyway and that CA's economic problems have nothing to do with our campaign. Let Arnold handle that! Maybe you should tell them that the security checks are in fact unconstitutional with the FP repetition and the 35 days validity. A pre-requisite to a successful campaign is for the majority at least to know the facts and be on the same boat. By saying contact your Congressman is not enough. The content and the reaction are equally important. The process is simple: Post the action and the results. Follow up. No need for any name calling. Accept criticism when you are WRONG! Our problem and other immigration problems ARE NOT DUE to any bad luck or "carma" and the Covernment appropriations are NOT AN X amount of money to be allocated, with us being the last in the queue..speaking of smoking jolly stuff and spreading misinformation behind a forum name for bravery.

I think you are still suffering from the hangover of the heated arguments and its time to cool down. Everyone is entitled to their opinions and as you said that everyone opinions change as and when one experience it. May be your opinions change to what the other person is saying.

Lets move forward and I agree with you on many issues though I am still not convinced on civil rights violation charge. With the same breath, I also acknowledge I don't have much knowledge on civil rights issues and with your inspiration, I will collect and read material on civil rights movements in this country.

We are steadily progressing in our NJ . The progress is not as fast as I would love to but nevertheless we are making some good progress.

Do not try to be a medical doctor for myself or anybody else. Do what you think is right. If you post anything that is not accurate or false you will get the same kind of treatment,i.e. correction swiftly. Once and for all. If you want to challenge any of my posts or activities, please do so in a professional way. If you want to know about Constitutional and Civil rights, there is plenty of info in the public domain.
Above all the fray, STICK TO THE ISSUES. take them one by one and express your opinion. My advice if you want to take it: Stay away from consultations.
I have been running campaigns from the 80s, so I know what I am talking about and I know what is harmful and beneficial. You want another "proof"?
Search my postings and see also what Rajiv is suggesting as a FOLLOW UP. That will tell you something! SO I SUGGEST THAT YOURSELF AND OTHERS START WORKING INSTEAD. The only criticism that can be accepted is if any of posts are inaccurate and come with a proof..face the real issues. As far as CIVIL RIGHTS, it may take time to realize. With most people it never really happens.

Most of all you mentioned is caused by the IGNORANCE, FEAR and ACCOMODATION of people. A campaign can be an experience to enjoy and a fight a lifetime experience, no matter what the outcome.
According to Rajiv if CIS fights this, expect results in a year as a minimum. So it is not really for my GC and others' in the same boat. It is mostly for justice and the people who follow.

I agree, the cause is way more imporant than people's ego's.

I wasn't planning on continuing the discussion anyways with people who cannot understand or accept that everyone doesn't have to be on the same page, and those who differ are not necessarily the devil. I guess intolerance and bloody-mindedness go hand in hand.

But as I had already posted priorly, I am for the goal, which ever way works is fine by me. Be it the legal and smart way of the current lawsuit and project symphony/ocean or the bloody minded bullshit spouted by others. All I have to say is which ever way works more power to the person who makes it happen!

On a parting note, the concept of "being attacked ", "only my way is right", brings into mind visions of the inquisition and on a more recent note, the McCarthy era, of "better dead than red". And that alone makes the ideas repulsive no matter how right they may sound.

As far as my credentials are concerned, those who have been with me in my conversations with Congressman Anna Eshoo, etc. will attest to the lucidity of my arguments and my commitment to end this backlog. I have yet to see more than a couple of emails being sent and BS about how people have suffered due to this fight "by getting notice" from others.
