Emergent trip without AP approval ? Pls advise

Hi, there,

I need an emergent trip back to my home country, however my emergency AP with VSC is still pending, and the expedite request of my AP process with FAX receives no response from VSC.

I heard of we are not supposed to travel without approved AP on hand, it is taking risking when coming back at POE. and if that is the case, the I-485 is regarded abandoned. My question is does anyone have any successful travel experience without AP before leaving US then have a later-approval AP to enter US(say have someone mail the AP to home country) ?

The reason I am asking is I really have to start this emergent trip. Is there any other options I can turn around ?

Please help me out ASAP , thanks a lot !!!!!!!
 
Never leave US soil..................

without having your approved AP in hand. If you are still on H-1 and not using EAD, you may travel using your H-1.

You may visit the local USCIS and try to get an emergency AP showing the proof of pending AP application and proof of emergency. Did you contact your US Senator or Congressman's office for help? Sometimes their help gets things moving.

i am planning to travel abroad in dec and my current ead and ap expire in nov. do i have to apply for renewal of both? and how soon?
 
give 3 months ahead of time, I think

I think you can apply six months in Advance. If you are almost certain you are going to take vacations in December and your I-485 adjudication is not likely to be soon, I think applying now would be a good idea(especially EAD).

-----Send EAD renewal NOW. AP is not renewed it is always NEW so file for new AP now so that you get your NEW AP before you depart US in Hand

What if I485 approves when out of country using AP

If I am out of country with a valid AP and while I am out 485 is approved, Can I enter back into US with out any issues? What are the issues if any...

There should be no issues as long as your AP is valid. That was the exact reason they issued you AP so you can leave and enter the country...
 
I want to go to india for my brothers marriage. I have applied AP on April 16, still no response. Marriage is on June 30 th , can go and get Emergency travel document in Local USCIS Office. IF so how long it will take for me to get the Emergency Parole.

emergency AP approved today @ newark,NJ

Hi, there,

What a relief ! My emergency AP got approved today at Newark local office, I went to Newark three times to try my luck, and finally I got it today. First time, I did not have a I-131 receipt from Vermont, turned down, Second time, was told to contact VSC to expedite request, did that, no news after 10 days. And today,I decided to go to Newark last time, I did get it. My reason for emergency AP is medical surgery of my family member.

Just for your reference.

1) what is the validity period of your emergency AP? is it for one year?
2) I also got my AP from a local office recently. I had to go to the local office because I needed to travel soon and there was an error with my name in the AP i got from TSC. But the AP that I got from the local office looks inferior to the one from the service center: no picture embossement, just a plain paper with my photo pasted. No special paper, just a plain paper. Is your AP like that too? I just wonder if my own will not be accepted at the border.

I also have a similar problem in my wife's approved AP (from VSC) has a mistake in the lastname. Pls share your experience in getting a corrected one from the local office.
-Did you have to surrender the incorrect AP?
-Were you suggested to get the corrected AP only thru the service center?
-What is the validity timeframe on the temp AP?
-Did you have prove some other emergency for getting this corrected AP?
-Was the (approval) date on the corrected AP same as that in the original AP from the service center?

I have seen posting elsewhere that the temp AP (with a non-embossed photo) is okay at the POE.

1) Yes, I had to surrender the previous AP to the local officer
2) No one suggested that I go to the local officer. I only took a chance. So I got an appointment through infopass to speak to an immi. officer. Before going, I completed a new form I-131 and took new photos just in case. I was almost turned down but suddenly the officer realized that they could replace it for me. The officer took my new application and photos and it was ready in one week.
3) The new AP is valid for 1 year, different from the date on the previous AP
4) I did not have to show any emergency reason

I hope that I did answer your questions.

can anyone please give me a list of documents to submit for AP & EAD

Aslo what to write for AP form part 7: Explain how u qulaify for AP and circumstances that warrant your AP?

document list per my experience

I got emergency AP on June 14 (same day) at Newark, NJ. The following is the document list I preprared :

copy of AP receipt from VSC
copy of I485 receipt
copy of I-94
I-131 filled form
copy of driver license
copy of passport with photo page
two photo ( if you wanna same day AP)

Thanks guestUSA for your reply, One quick question how soon i have to go the service center. My online status has not changed, but updated date is changed to today , is that means they are processing my application. Is marriage is considered as an emergency visit. What you have told the officer about the emergency.

-------In fact I have the same confusion. It happens to my 2FP. I just posted the question, and waiting for the answer.
Is marriage is considered as an emergency visit. What you have told the officer about the emergency.
-------the reason for my emergency AP is medical surgery of my family member. I am not sure how it goes with Marriage reason, anyway it doesnt hurt if you try.
