Good job! If your daughter's university fin. aid office will refuse your request then please ask them to contact FAFSA's only supervisor "SHAUNA MARQUEZ" at 1-800-433-3243 (FAFSA 1-800 no. and ask for her) and she told me today evening that she will guide the university what to do in this case.

In my case, I have to first fight with registar office to change my son status from 'international student' to 'in-state' then I can contact fin. aid office.

I have received your letter requesting financial aid for your child here at (university name). Per federal law, only students that are permanent residents or U.S. Citizens are eligible for federal financial aid. This includes student loans.
We can offer financial aid only to those students that are permanent students or U.S. Citizens.


However, I checked eligibility of other noncitizen category with the latest SFA Handbook for 2003-2004:

and I found new category for Other Eligible Noncitizen at page 1-23:
Persons paroled into the U.S. for at least one year. These individuals must also provide evidence (such as having filed a valid permanent resident application) from the BCIS that they are in the U.S. for other than a temporary purpose and intend to become a citizen or permanent resident;

My daughter (my daughter's name)'s case exactly fits to this category. As I attached our I-485 receipt notices in my previous letter, we have filed I-485 application for our green cards to become permanent residents even though they are still pending due to USCIS processing delay.

Please confirm my daughter (my daughter's name)'s eligibility again and let us know.

Also, I'd appreciate your information about new eligibility for other noncitizens.
My daughter will be able to get a scholarship this year.

Hi, Rajiv,
I think most of AOS pending students will be eligible for Federal Scholarship this year because of FAFSA's update of criteria about other eligible noncitizens.

So, the real hardship is:
some students such as feb6361's son and vikram_vetal's wife have to pay Internationl Student Tuition or cannot apply some universities
simply because they are not permanent residents due to USCIS processing delay.

I have only informations that I have posted here with link and I confirmed that with the above contact at FAFSA that if I-485 is pending over 1 year then you are eligible for federal aid.

Thanks for information. However iam not very clear from your posts whether a student can apply for FAFSA aid if AOS is pending. Is it state/university dependent whether student will be considered for aid ? Appreciate of you can clarify.

Iam also in the AOS process which is pending for 2 years. My son will be going to school this fall. He has received a letter from school that he will be considered as resident of state for admission and tuition.

For the speciific Grant, Scholarship, or Loan, it depends on University, based on applicant's finanicial status or GPA, etc. .. but I'm not sure.

The last year, our children were not elibile for FAFSA simply because we were not permanent residents, and it's changed this year,
so most of counselors may not be informed.
You may want to contact a counselor of your son's university as soon as possible.

feb6361's son's university should consider him as a resident and reimburse the tutions that he had paid as International Student in past.

1) I called to my daughter's university but the counselor was not there.
The lady I talked didn't get the porint and asked me to call back next week.

2) I called to FAFSA 1-800-433-3243 and I was told that my daugher should be eligible and to contact her university again.

3) I faxed another letter to her university again.

Thirdly, this is my example. My wife has a Master's. Since I am a H1B, she is on a H4 and cannot work. Even if she wants to go to school, she cannot. We have to pay "Out of State" tuition and sometimes "International" tuition fees. Waiting for her greencard so that she can either go to school or start working is killing her career.

Can we also ask such that H4 Visa/L-2 Visa is automatically treated as a work visa.

Thank you for the response. Yes i know iam lucky to be considered for in-state tuition, however i contacted the university today and was told that my son was not eligible for FAFSA as a non-citizen. Looks like everyone is not aware of the changes. I will try again and once again thanks for the response.
