Bad News for those with Recent I-485 RD

Bad News for those with Recent I-485 RD


I called TSC today and I was told to forget about the approval of I-485s based on "name check pending for more than 6 months" memo. The obnoxious woman said that the USCIS is now going by the new memo and that they will NOT touch my file till November 2008.

Meanwhile, it is likely that both NSC and TSC might be approving I-485s with RD of 2007 (even June 2007) and no body is to question the USCIS on those approvals because their response will be that the approvals are based on those applicants' FBI name check being already cleared.

Now, who is going to stop the applicants who are stuck in name check from flocking to a Representative, Senator or the First Lady to get their FBI name check expedited. I can only laugh when Americans talk about red tape and nepotism elsewhere in the world.

I just hope that both USCIS and FBI will keep up to their word on the timetable on name checks.

I called TSC today and they told me that they no longer follows the Feb Memo where the GC will be approved if the FBI name check is pending for more than 6 months instead they are following the April 2nd, 2008 Memo where I need to wait until Nov 2008 or Feb 2009.

IO also said that I need to wait Until Nov 2008 or Feb 2009 before calling them again as FBI will not process my name check until late 2008 based on the new memo. FBI is going to clear name checks for old cases first that are pending for more than 2 or 3 years. All I-485 petitions that were filed last June/July 2007 with pending name check will be taken up for processing by FBI only by late 2008.

I do not have any hope that I will get the GC by April/May time frame. I hope FBI clears the pending name checks as per the new memo.

This just does not make sense. I spoke to them on Wednesday and the IO did not mention anything of that sort. Moreover, if USCIS were to stop doing something that they had officially communicated (i.e. to adjudicate 485 cases where FBI name checks were pending > 6 months), they would go ahead and officially communicate that. Some people may say "They are USCIS. They can do whatever they please". Well if that was the case, why do the whole charade of the original communication in the first place. The FBI name check waiver, if I recall correctly, was approved at a higher level of authority (DHS Secretary) and not just at the USCIS level. They may just be trying to scare us folks since we have been pounding them with phone calls.

Unless I see a written communication, I will not buy into this rumor. Also, I found an AILA agenda/meeting minutes document (dated 04/02/08) which acknowledges USCIS's change in policy to approve 485 which have name checks pending > 180 days. Here is the URL. On paper you might be right however most of the forum people have not noticed such practice otherwise by now there should have been lot of approvals having old RD's and current PDs.
