Hehe.. I am in the same boat. I'm going abroad for thanksgiving and I'd hate to have to use AP because I didnt get my card yet! I can't wait to come back in and be treated with some dignity finally. Fingerprinting and picture taking its not so much fun.. :rolleyes:

As far as I know you can't use AP after GC approval. The only solution is to get stamp into passport.

Thats not true, please confirm with your legal contact. You should be able to use a valid AP document even though your cards have been issued to you. Now if you have the card in your posession it does not make sense for you to use AP instead of the card. I know of a lot of cases where people got I485 approvals while they were out of the country and they entered using AP with no problems.

I don't think there should be any problems using AP but I haven't checked with my lawyer yet.

Yes, that's true. That's OK to use AP if you are out of country while GC is approved. But if you are aware of your approval and you are going to leave US - don't assume that AP is valid.
I will not ask my lawyer about that - it's too early for me. May be in 2 - 3 years ...

but hey, how do they know that one is aware of their GC approval? There are tons of people who do not subscribe to the email notifications of USCIS. They just find out about their GC once it arrives in mail. and I don't think they would go to the length of tracking your case to see if you received an approval email or not - ok even in that case, what if you did not read your email? This just doesnt sound reasonable.

The question is will you take risk to have troubles on the way back? To clarify my view I have not heard anybody have problem on the point of entry but theoretically AP becomes invalid when GC is approved. The only exception is when GC is approved while abroad.
Talk to your lawyer before taking risk.

ok so I found from my attorney is that I need an ADIT stamp if my case is approved prior to departing the US. But to get that stamp I need a I797 approval notice from USCIS. But what if I only have the approval email, but no notice?
 
Card received!

And finally today I got the card and the welcome notice in separate letters.

My card is totally underwelming on the front. All the name, picture, fingerpring seem to have been badly scanned and yanked in there with plastic. It has actually been printed on top of the GC plastic and there is a protecting cover on top. There are a few holograms on the top that say "Department of Homeland Security" but it still looks cheap.

The back of the card is much more interesting. Most of it is occupied from what it seems to be a holographic band that has the picture, my name (truncated because it doesnt fit), a CARD# LIN06177XXXXX field, DOB, expiry date and alien number. It quite fun to move the card so it reveals all these detais that can only be observed at certain angles.

Funny thing is - as I look at your 140 and 485 dates, they look exactly same as mine including the Finger Print date and some of the LUD dates. I have not yet got the 140 approval as I did not do the Premium Processing. Yesterday I talked to the lawyer and he mentioned that my 485 approval is perhaps waiting for the 140 to clear. He recommended doing premium processing to complete the entire processing. Also he mentioned that max time for 140 approval is 6 months and I have already crossed 5 months, so its just another month.

I am unable to make a decision as the choice is between 1 month and $1000. I have waited so long (about 4+ years), that waiting for another 1 month is really not bad. The other part of me tells me to spend $1000 and be done with this stupid GC processing...

If you are not in a hurry you can probably save your $1000. You should hear from your I-140 in a month or so, and looking at the current trend I-485 are going very fast. But hey, paying $1000 almost guarantees you to get the green card in the mail in a month.

Its not guaranteed that you will get GC after I-140 approvel. Take my case
My FBI Name check is not yet cleared wheras my wifes name check is cleared. So the point is there is one more wiat before GC and that is FBI name clearence. hope you guys have your name cleared fast. ;)

Well, he can check to see if the name has cleared. If it has, I think his I-485 should go pretty fast.

Your case received an RFE. Your attorney should get it in mail over the next few days. After a response to this RFE is submitted, your case would then e queued for a potential approval.
 
I filed 485 on July 31st 2006 but NSC current processing date is March 17 2006.
Two questions :
1 Can I take an infopass if NSC processing date has not yet reached my Filing date ?


2. I have not received FP notice. Is there something to be concerned about ?

Goto USCIS website, apply for an infopass.
at USCIS office you need your I-485 Case numer to retrive your record.
the bottomline is if you have Case # you should be able to get information from them.
hope this helps.
Can you ask a question that when they send FBI name chk query .....is it after filling 485 or after approvel on 140.
