EB2 485: Pls post here

Went there on Wednesday and got my FP done, they didn't even ask why i missed my appointment int he first place?

I-485 Approval

Got an email from USCIS that my I-485 case has been approved. This surprised everyone including my lawyer. MI / Nebraska folks --- Looks like approvals will be flooding soon.

Note -- My case is in EB2. Look at my signature for further details.

I have a question, not sure if this is the right forum to ask, please direct me otherwise.

I am ready to file my I485 with all documents ready to go but my H1B extension is pending. My previous H1b has expired already. I do have the I797C receipt notice for the H1B extension application though.

Is it advisable for me to wait till the h1b extension is approved before filling the I485? or just submit 485 now with the h1b extension receipt notice? I think it should be fine to file 485 with the receipt. what do you guys think?
 
I was exactly in the same situation and my lawyer told me that there is no problem to file I-485 while H1B extension is still pending. Worst case scenario you will get a RFE to show that your extension is approved.
Do not waste time and file I-485.

thanks vali, I had kind of made up my mind to file it now with out the extension approval already anyway :)

I dont understand why they would issue an RFE for this case, since they are the ones who KNOW if the H1b extension is approved or not, they have the A# , I94# and everything to check that in their system. They are USCIS themselves after all, but well, knowing how the system is - may be not :)

Many people get RFE for documents they already sent along with the applications. Earlier in this thread I asked the same question and it seems that it is easier for USCIS to ask for documents or maybe they simply hope you lost your approval.

Did anyone with PD Nov 2002 and after get their 485 approved??
 
485 RFE message

My 485 LUD was updated today to 05/19/2006 and it has following message on the USCIS online status:

"On May 17, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 30 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours."

My wife's 485 LUD hasn't changed and is still at 02/14/2006. I called the lawyer and lawyer's office hasn't received the RFE yet. Hopefully they will get that on Monday. I am very curious and anxious about this RFE.

My questions:
1. Anybody received similar message? If so what can I expect in the RFE?
2. Shall I expect to get stuck into namecheck Q after responding to RFE? OR it's a good sign to get RFE like that (namecheck completed???)?

As with most others, my gc lawyer and lawyer's office are damn lazy and careless ones!!! :mad: I called lawyer's office 3 times since Monday and everytime I got the answer : "We haven't received it. Will let you know once we get it". They should have got it by now since the RFE was mailed on 17th May per online message.
I had two bad experiences before when the lawyer's office got the letters and it took atleast 2 weeks for them to let me know!!!
This time, I have decided to be on their back and will post the RFE content as soon as I get it.
