As far as I know AR11 has to be filed by law shortly after you move, within ~10-20 days. There is no 1-800 number substitution for that. 1-800 changes your address on your pending INS applications, AR11 is an overall "alien locator" form. I do not think that INS will make any inferances from that form about your new employer with regard to your recent GC approval. They should have a specific reason for doing that. Well, after you become USC you will stop worring about all these forms. :)

BTW, I also asked my lawyer, he didn't seem very concerned about this. The 1-800 ... I'll have to call because they sent me emails for both my case and my wife's (I-495). They are already approved. We have the cards and all. But apparently USCIS is sending approval notices twice, and up to three times to the same people, according to my lawyer. So, they're trying to send me the approval again and it bounces in the mail

Called VSC

I just called the Vermont Service Center, and was told that my case should be decided within the next 30 days. The lady said my FBI name check had cleared. I asked if I should be worried that my LUD hadn't changed since 4/8/2005, just one day after I got fingerprinted, but she said no. Apparently my LUD not changing just means that everything is going smoothly and they hadn't needed to do any further checks. So, I'm hoping for the best. If I don't hear anything within 30 days, I guess I'll call again.

Hi Holbytla

You shouldbe just fine, most, almost all cases in this category are approved, it's mostly a matter of when, and your cases seems to be around the corner :D

LUD, online notifications et al are all unreliable. Good if you get them, but many, many cases get approved with no LUD changes, hell, not even online approval message, just the letter. USCIS maintains the online system "ad-hoc". That is, someone updates your case online ... if they remember to do it. But your case is tracked somewhere else internally.

Just wanted to share my processing stats to this thread (though I'm not doing Outstanding Researcher but Extraordinary Ability), and a question.

I just discovered the online tracking at the USCIS website, and I saw the following:

Current Status: On June 15, 2005, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed ...

Is there anything to worry about, besides the I-693, which I didn't submit with the I-485?

If you did not submit I-693, I'm sure that's what the RFE is all about.
RFE on I-140 could have been a big deal, but that's already been approved, so no reason to worry about. Congratulations on the fast I-140 apporval!

In our case, calling our Congressman worked. Oherwise, I feel my application would have stayed in the infinite (pending) loop and never gotton approved. The lazy slobs at VSC don't absolutely care if your case sits on the shelf for a few years. The Congressman's office called VSC and made sure that our cases went to the "Congressional Department" at the VSC. It was only then that we got our FP2 notices!

Anyways, I'll feel relieved after I see the Notices in my hand!! :)

Got my passport stamping done in Boston... Now I guess I can breathe a bit easy, and wait for them to send me the card in the mail :)

I hope all the old timers (Barney, Antonl, Gegemon) get their approvals soon! The new guys don't have to worry too much, things are going very very fast now.

I think we guys (who applied in 2002-03) were the unlucky ones :( Anyways, hang in there and hopefully those USCIS guys will sort their mess out!!

Thank you for your good wishes for us. My case got stuck due to FBI Name Check. The only opportunity to expedite FBI name check is to file a writ of mandamus lawsuite against USCIS in a district court. Pending lawsuite mandates USCIS to request expedited namecheck from FBI!

Some info for anybody interested: Before filing a legal complaint in federal court you have to exhaust all other means to resolve this issue - I already have two inquiries, one expedite request and two letters to FBI. What is left are AILA liason and congressional inquiries. Plus first I'll try to send a draft of my complaint letter (which I plan to use for the writ of mandamus lawsuite) to US Attorney and USCIS Director. If this does not help - I checked that attorney fees run ~$2,500 plus ~$250 filing fee in district court. But you have to have a local immigration attorney so he/she can appear for the hearing.

Hey, I stuck in the same bottomless pit. How do you go about finding an attorney? Can it be any district court?

Definitely try the "Congressman" route (try a couple of times even if it does not work the first time). I think the only reason my case went back into processing was the fact that my local congressman's office called the VSC and pushed our (my wife's and mine) cases into the Congressional Unit at the VSC. This is a special unit that handles cases that have been referred to them by a congressman's office (I spoke with an officer at VSC and confirmed this).

Both your cases are waaaaaaaaaaaay outside normal processing time, and so I think the congressman offices will definitely be willing to do something about it...

I checked the "Venue" paragraph of filing writ of mandamus lawsuit, here what it says:

"Venue for the mandamus action ... can be in any judicial district in which the defendant "resides", in which the substantial part of the events or omissions giving rise to the claim occured; or in which the plaintiff resides".

So I would say it should be your local district court. As for finding an attorney for this case - it is better to have a local one so you do not have to pay for his/her transportation expenses in case of an actual trial. I would go trough the list of immigration attorneys in a local yellow pages book.

Hi, Guys, I am in the same boat.

I finished interview at local office, but still need to wait for name checking results. The only good thing is that I don't need to go to the local office again, and as long as the name checking is cleared, they will approve the case and send me the cards in mail.

I know nothing about the mandamus lawsuit and its effects. Will this really work? The interviewer told me the only reason for expedition request is some emergency situation, but I could not figure out what will be the "emergency" so they can request expedition of namececking.

I would try all things i could to make something happen. I saw someone who has been waiting for three years for the name checking ... so scary to me...

changing jobs

Hi,
My I-40 (EB-1OR)got approved in december 2004.Would it be difficult for for me to change jobs.
 
I485 approval

Hi,

My and my spouse's I 485 were finally approved on June 17th. Please help me to modifiy the form. Thank you.
 
I-485 approved and card ordered

I am happy to say that I got 2 e-mails at 4:45 pm today, July 1st, stating the following:

"On June 30, 2005, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready."

What an odyssey! I was stressing out over the fact that I was not getting any LUDs on my I-485, but as others have said, this is not necessarily an issue. Thanks for all of your advice and support. This forum has been great.
