Well, these gray areas seem to be the USCIS' modus operandi. I remember reading somewhere that the USCIS was preparing to issue a clarification to the Service Centers regarding this issue but until then it was advisable to not change jobs unless the 140 was approved, simply because each case officer in the service center was interpreting AC21 any way they wanted to. BTW, I think it is extrmely likely that the 485 processing dates may overtake the 140 EB1-OR dates in the near future! It seems to have done that in the case of EB1-EA already !!

Also, I may have confused the ASC with the Field office. I know you gotta go to one of them and not the other. Let us know how you make out.

Early FP2 at Dover Report

Thanks July02EB12 and Samamit , not only for the info, but also for posting when you were almost sure I was on my way already. And that was the case.

In short, we got them done. BUT, there are always "but"s with uscis. There are some interesting details for people attempting for early FP, keep reading. Also, something went somehow wrong and I'd love to here some suggestions. Another reason to keep readin.

It was like July02EB12 anticipated. In fact, there was a typo in our FP2 notifications, or should I say a mistake. They SHOULD send you directly to the ASC. That's where we got them done, after bouncing off the Field Office.

In both places they made it clear that you have to go on the specified date. They were not happy at all with us going early, really. In the ASC, because I knew they would complain from my experience in the Field Office, I started off saying "we are scheduled for FP2 in 10 days, but my wife starts working next week, and it is going to be very iconvenient for US to come ..." They took it as a favor, they did it as a favor, I took it as such. Here is how I read the situation: they are allowed to do your FP's as far as you have the USCIS notice for FP, but they really prefer if people go on, or after their scheduled date

The other issue, my wife's FPs were not very "visible" on the digital system. Actually, FP1 did not work for her, and it was stated in the FP2 letter that they could not use her original FPs because they were not clear enough. The technician said: "90% probs that they'll need you to do new FPs". WTF ! So what ? The issue is, my wife's skin surface is very smooth, and ink FPs work fine but digital ones seem not to work. Any pointers gals/guys ? This is important, I have the chance of applying for an important position, but it would really help to have our GCs approved soon for that. Gee, even getting mine approved soon would help. Do they do that ? Or are they gonna wait until everything is ok with both our checks ?

No, we're screwed up with my wife's FPs ... Oh well ! Sooner or later it's gonna happen. For what I gathered on the FP forum, they'll send us (hopefully soon)a new call for Ink FPs, and some day, who knows when, get the approvals ...

Congrats on your getting your FP2 done. I guess after an agonizing wait it was well worth it, right?? Good for you. As you know I'm still waiting for my FP2. Who know, maybe one day someone will wake some guys up at VSC and they'll start speeding things up. Until then I guess we helpless souls can do nothing but wait!

Anyways, when your got your FP2 did your LUD change at all?

Oh yeah, it means they are finally looking into approving your 485 ! Of course it didn't go all that well, but at least things are moving again now ...

True. My guess is: if you don't get early FP2 or 485 approval (i.e. almost at the same time they approve the 140), then the most likely thing is that they'll review your case when the current processing time approaches your RD. And the'l call for FP2. Wish you the best of course !

Not at all. Checking your LUD everyday seems a waste of time, hopes and energy :( Check the Fingerprint forum I linked from the tracker. Lots of useful info !

Finally received my I485 approval email.. after 3rd FP.
(I got a letter from INS two weeks after FP2, saying my fingerprint was rejected and I had to do the 3rd FP on 9/16/04)

Guys

Our status table needs updating if anybody has time. Since my I-140 approval I have been monitoring things very closely on my own spreadsheet and I think there is reasonable cause for optimism on I-485 approval times in the VSC EB1 OR category.

Of the 18 people in this forum who have undegone FP2 since 6/16/04, 8 have I-485 approvals (kxw, ea_ead, Goodluck09, slipj, July02EB12, katvar, hueymeei1 and skusa). Minimum delay after FP2 is 2 weeks (skusa) and maximum is 10 weeks (slipj).

Of the 10 that remain unapproved, the longest waiting time since FP2 is 13 weeks (CosmicDream), while 5 of us have been waiting for 4 weeks or less since FP2 (I did mine yesterday, as scheduled).

Let's hope things continue to accelerate at VSC. Good luck to all!

I think an FP3 is very rare case ...
I found my SSN was printed wrong in my FP2 notice, and I asked them to correct when I was doing FP2. They told me they did not have permission to make the change. Our lawyer said it's no big deal and we could ignore it.
But 10 days later I received a letter saying my FP2 was rejected by FBI. We thought it's related to wrong SSN. I filed letter to VSC to correct SSN and went ahead for my FP3 anyway. I thought I was going to get a letter for FP4 again since it took at least a month to get a response from VSC for my SSN letter, but this was a surprise I got I485 approval instead!
My husband had FP2 on the same day (8/25) and got his approval on 9/23.

Of the 10 that remain unapproved, the longest waiting time since FP2 is 13 weeks (CosmicDream), while 5 of us have been waiting for 4 weeks or less since FP2 (I did mine yesterday, as scheduled).

The one missing bit is that there is a small bias towards approvals, because two or three people requested to be included in the tracker some time ago, we asked them to do it themselves or put their info in a more friendly way fo us to include it and they never responded ...

It'll be interesting to see if they keep this pace now that they start processing H1 visas again (starting tomorrow) ...

need advice

Hi guys,

I need advice from people on this forum. I filed my 140 in oct 2002 and 485 in jun 2003 (EB1-OR) and was approved in aug 2004. PP stamping done already. But i filed 485 for my wife and daughter in jan 2004 (they were in india when i filed my 485). NO FP yet. I filed for AP for wife and daghter last month and was approved already. no LUD change on 485. My question is that my wife and daughter are planning to go to india for alteast six months. can i postpone the FP date for six months (if i get it immediately after they leave). Please post if anybody have postponed their finger print dates.

Finger Print Notice

My lawyer receive the finger print notice for my husband and me (I did not receive it myself).

I have a couple of questions: (at Newark, NJ)
1) the appointment dates are different for my husband (10/23) and me(11/9). Can we go together on 10/23?
2) 10/23 is Saturday. They work on Saturday?
3) We are given the time (10:00am and 8:00am). Do we have to be there at the exact time?

I did not get I-140 approval yet. Does the FP notice mean that the approval will be soon?

BTW, I filed I-140 on 11/4/2003 and 485 on 11/21/2003. EB-OR
