EB1 Outstanding Research Tracker

Hi,
My LUD changed on august 12, 2004 after I did my FP2s on july 6,2004. However, the message about my I485 status is the same as the one for FP1.
The usual... your FP etc.. but the date is Feb 14, 2003 and not August... do not knwo what to make of it.
Just though t o let you know.

After our FP2 (9/9/04), on 09/16 my spouse's online status was updated not mine. Why not mine??? I am worried, though, so many of us in the same situation!

I Need advice,
Should I renew my Advanced Parole that expired back in Mars or wait a little longer? My 2 years date on my I-485 will be Nov 19th, 2004. My details are below in my signature.
Also, what has been the trend in terms of renewing the AP lately?
MZGH
PS: I need to see my mother before the end of the year.

Hi mzgh

Hard to tell. The only objective info I can give you is that I renewed my AP in late August, and got it approved in about three weeks total.

It seems that it is very likely that you;ll get approval soon, but you can't count on it. If I am not mistaken, you would then get stamped in a week or so, and the paassport stamp is equivalent to a GC.

The conservative approach would be to go ahead and get the AP right away (and EAD too if it is expiring soon). I'd do that. Most likely the AP will be approved on time for the trip. I would fo this because I prefer to spend a little money buyt play safe. The most you can lose is some time and money. But if you decided to get AP, you'll have to do it ASAP. They take up to 3 months in principle to do it

Good luck!

AP Renewal

mzgh

If you need to see your mother before year end I would apply for AP now. The website says September 13th for I-129 at VSC. I don't know what the backlog is REALLY like now, but I applied early (Feb 2004 when my expiry date was April) thinking it would come through quicker but it was not approved until end of June.

I sincerely hope that your I-485 is approved soon, but you can't assume anything with USCIS!

I just received 2 emails saying that they received the FP's for my wife (the same email twice) last friday "and processing resumed on your case". Her LUD is updated as of today. No updates online for my case, and we went together.

Yes, things are THIS weird

I still think we should not stress with LUD and online status. Any news over there is good news, but no news doesn't mean much ...

Hi!
Though I have a H1-b, I may have to use my EAD as I am planning to change the job(jobs don't wait particulary in scientific field). My EAD is expiring in FEB-25-2005. I not only I agree with our mendieta I am going to (practice) apply for EAD very soon. I feel playing safe is the best policy when we deal with USCIS. I have seen worst things happened to people who took USCIS for granted!!! Nothing is sure in USCIS world!!

.

Exactly same thing happened to me also! It is amazing! No LUD in my case till now. Expect the same!
One thing I want to ask you- when you did your FP1, is your wife's online status also changed into "and processing resumed on your case" along with yours?
In my case, after FP1, my staus changed into "and processing resumed on your case" but wife's was pending till her FP2 results.

Hey Rajan

Maybe we are twins or something, who knows ;)

Our case is almost eactly as yours, except for one difference. After FP1, both LUDs and messages were updated. But my wife's said something different than mine. I had the usual "... processing has resumed in your case ...". My wife's said something like " your fingerprints are pending review". Apparently, what it meant was that her FP1s were un-readable (we know that because it was stated on the FP2 notice). The good news for us now is to confirm that FP2's went finally fine for her (and they actually told me so on the phone from the fbi, so this is just a confirmation of the fact)

Oh well !

No! there is no difference! In my wife's online status also had the same message "your fingerprints are pending review" untill 09/09/04. It is so same man! Infact I remember during the FP1 my wife was struggling with her finger prints taken. She did three times.
May be it is possible that since our wives FPs are pending for year and half USCIS just wanted to update only theirs as our cases have been resumed already!!!!!!
Actually, I remember from your past postings about your(and wife) FP1 message so I was expecting that pattern of our LUD changes might be the same.
That is what happened!!
Good luck!

Questions about Finger Printing

My lawyer received the finger printing notices (first time) for my husband and me. I did not received them ( I have waited for a while since my lawyer received them). My lawyer said that he is going to mail the notices (original) to me. My question is
1) can I use the notices which were sent to my lawyer to get my finger print done?
2) the notices which were sent to my lawyer are the same with those which were supposed to be sent to me?
3) I heard there is finger printing fee. Did the I485 application fee include it? If not, should we pay the fee on the day when we do the finger print? What is the rate? pay by check?

Thanks.

BTW, I planned to call CIS to check the reason that I did not receive the notice. But, it seems to me that my lawyer does not suggest me to do so.

Answer to 1&2 -The notices are sent to the lawyer and the applicant are the same. So you can gohead for FP with lawyer's notice.

3.I didn't pay any fee during the finger printing. I beleive it is included with I-485 fee.
Hope it helps.

Thanks guys. Doing the AP thing seems to be my next step in the upcoming weeks. I was hoping that the trend of i140 approval followed by i485 approval within 2 month window would hold but it seems that I fall in a tougher category based on where i come from. ah....
thansk again.

It makes sense ! It actually makes too much sense to fit in the USCIS chaos. It's either an incredible coincidence, or an incredible lapse of making sense from the USCIS online services ;)

Anyways, cheers and keep up the good spirits everyone,

Correction

Following my analysis of September 30th, I have discovered that CosmicDream was in fact approved on Aug 11th, only 7 weeks after FP2. I have corrected the table to reflect this. mzgh now has the longest delay from FP2 to aproval in our forum (12 weeks). Any day now, my friend!

I think after mzgh, I have the 2nd longest wait after FP2 in this forum - 80 days (11 weeks) today since I complted FP2 on 07/17/04. There does not seem to be an end to this GC nightmare.....

Here is an update on the from FP2 until Approval waiting time, now that RPB added CosmicDream's approval (thanks !!!!)

.Only approved cases are considered.

---------------------------------------
kxw --- 35
July02EB12 --- 32
CosmicDream --- 55
slipj --- 76
Hueymeei --- 34
ea_ead --- 48
katvar --- 32
skusa --- 14
----------------------------------------

The quick result: typical wait is (6 +/- 2) weeks, or between 4 and 8 weeks.

Average: 41 days (6 weeks)
Standard Deviation: 17 days
Most likely value: 4-5 weeks (Assuming we would build a PDF from these few values ;)

Of course, low sample statistics, but it gives an idea of what to expect ...

Life never gave me gifts and I earned everything the hard way. This is nothing new to me. I think I know why the delay since I come from a hot spot. I did science and lived like a humanist. They probably think that I am saint and they are having a hard time believing that.
i will keep waiting and hold the record for a while. Not too long though, please.

mzgh, I am neither a scientist (at least not anymore, having deserted academia for industry!) nor have I lived like a humanist, and I am not from a particular hotspot (I am from India, like half of everyone on this portal). So, I am plain puzzled by the delay, and being a good Indian, I can only blame it on my fate and pray to GOD. I think our old Indian philosophy of everything being preordained by the fates and we just being puppets in a grand cosmic play is correct after all!!

gc-despo, mzgh, hang in there.

Let's hope the USCIS gives a big boost to the Current Processing Time as it hyas been doing in the last months (except for the last update). That's all we need. Because then we can call USCIS Customer Care. Before this happens, we gotta try to take it easy, or perhaps consider going to another country. There are several good countries to work in (I don't wanna go further than this to avoif off-topicisms)

Cheer up!

Mendieta,

Yes, other countries is a good suggestion. In order to spread my risks, I am also in line for past 9 months for Canadian PR. However, these days India is more promising than Canada, so going back home is my main backup plan in case US GC does not work out. Its just that after waiting 22 months for I-485, and going thru all the hard work of putting together I-140 EB1-OR application and getting it approved (that took 15 months), I have reached a level of "frustrated anxiety" about this process, and spend at least 1 hour, which would have been otherwise spent more productively, a day on browsing thru this website. And I would really like to put this thing behind me, as I am sure all of you do too :)
