Thanks for the info. Mendieta. But I do remember someone mentioned a very nice experience when calling the FBI info desk. I could not find it anymore, and it may be in some other threads. Anyway, I won't do anything unless I am 100% sure it is ok :confused:

I would really stay away from the FBI. Unless some has really firm, solid info advising otherwise, and this should be your lawyer. Chances are, you can screw up. FBI may not want to release any info in any case, I totally doubt that calling them will speed up things in any way, and I could think of many reasons why this call could screw up your case. May be they will wonder why you are calling, may be they think you are afraid they will discover "something about you". You know.

Plus, 99.9% or so of the FBI checks go through ok as far as I know ....
 
LUD change with FP2?

No LUD change since my 7/27 FP2 (probably too early to expect this). Has anyone had a LUD change with FP2?
I have a bad feeling that if real "concurrent" processing doesn't happen for whatever reason, we are at the mercy of the slow and catenkerous "current processing date" arthritic tortoise!! (hope I am wrong).

Any thoughts?

Someone reported earlier in this thread that his/her impression is that when people go for FP2, their cases get approved in 1-2 months afterwards. This is what he/she learned from lurking on another Vermont 485 tracker.

Maybe the reason is that it takes about this time to get clearance from FBI. Remeber that the FBI got much slower (and careful) with background checks after 9/11

The lucky people who get I-140 approved before their FBI clearance expires (15 months) are typically getting simultaneous approval (140/485)

One more thought: USCIS has been reducing the 485 backlog consistently in the last three months. Elections year, you know :D

The 2-month period that you are refering to has been the trend and some of us should have heard by now at least starting August 10th. No LUDs, no mail, nothing yet. However, I did hear of a case where the benificiary heard from his lawyer instead of an email from BCIS or a change of status on line.

My 485 approved today

I was surprised to receive the INS notice today that both my wife and my 485 cases (RD: 5/27/03) were approved. My 140 EB1-OR was just approved last week.

My 140 RD: 4/30/03. My wife and I did our 1FP in April 2004. I think that our FP is current is important for our immediate 485 approval.

I know how lucky I am considering so many people ahead of me are still waiting. Hope you all have good news very soon.

I can finally go back to visit my parents now. Cheers!

Yep, see my post above. There is no question about it: with the Fuji memo, for people in our time frame, it is much better to be semi-concurrent and have a valid FP by the time they process your 140.

Oddly, before the memo it was the other way around (the sooner you got your I485 petition in the better)

You NEVER know with USCIS, that's the general rule

Oh, a question, why is it that before approval you could not go to visit your parents ? Didn't you have Advance Parole ?????

I applied my AP this year and got it last month. I am kind of hesitate to use it since some people say it will nullify my H1B (I did not apply EAD). I even applied a canada visa last week planning to have my H1B stamped in canada in order to go back to vsit my parents. Now all pains are gone and I am relieved.

Thanks ! I applied for 2nd AP and EAD last week, I HOPE it triggers 2nd FP and ultimately 485 approval soon, but having to do a new FP, I have at the very least a couple months ahead, maybe half a year ... oh well ... let me be happy for you for now :cool:

Oh, and for the record, my lawyer is convinced that using AP does NOT affect your H status. In fact I did travel some time ago under these circumstances ...

1) when you move, you file a notification (or call USCIS on the phone, dont remember). Have you notified them ?

2) According to my lawyer, even after you notify them you moved, USCIS might decide to keep the 485 processing in the original processing center (vermon for us), or the may decide to transfer it to the center corresponding to your new address.

So, my feeling is,

a) if you did 1) above, you can call the uscis 1800 number and ask what to do

b) you may prefer to just make the trip if you get cheap tickets. If you ask for case transfer to california, who knows how long it will take

This is just my feeling, I hope you can get better advise from your attorney (yeah yeah, I know it is easier to talk to the Pope in Rome than to your lawyer across the street)

Oh, and BTW, moving from NJ to CA is a no brainer, no one can blame you :cool:


Thanks for the info. Mendieta. I had called the USCIS but they said you have to have the pending case receipt number to change your address with them which I did not have at that time. But I filled the ar-11 and sent it to the homeland security ofiice.I too think it is better we go to nj and get the work done.

FP2 to approval - timelines

I went around and browsed through a whole bunch of 485 tracker threads (almost all pertaining to applications from the second half of 2002). It does appear that the time varies between 1.5 months to 3 months from FP2 to approval with variables including I-140 portability usage.....(but then again, BCIS will always make an exception to this "rule" to have the pleasure of being involved in our lives for much longer :eek: )...lets apply this to what we have on our list and see whether it goes that way...

I've found exactly the same thing. I looked at a bunch of September 2002 approvals from the VSC: shortest time from FP2 to approval was 1 month. Longest was 3.2 months. Average was 66 days (2.19 months).

I-485: LUD change today

Hi,
the LUD for my I-485 changed from 02/17/03 to 08/12/04 (today).
the on-line message remains the same as that of the 02/17/03 saying that my FP1 results have been received etc....
No email from BCIS yet.

SlipJ, Looks like our thinking on this is correct - VSC actually :rolleyes: starts processing the case when the FBI clearance reaches them (by the way, your very numerical approach shows how well you fit the OR category :) )

mzgh, congratulations on your impending approval. Would appreciate your input on what happens next (what do you get in the mail, how to schedule appointments for stamping, what is the timeline for stamping etc.)

I think you will get approval soon. I think that the LUD change means your finger prints review has been received from FBI.

On related news. When my I140 got approved, I didn't get any online notification. My i140 case still reads "pending" on USCIS' website. BUT, the day they approved it (as per the approval letter), the LUD got updated.

Good luck everyone, and someone wake my officer up please !!!!!! It is about time for me to go for FP2 !!!!!!!!
 
Please analyze this!! Approved 485 but company is shut down

I have an approved 485. I applied concurrently in the EB1(outstanding researcher) category and everyone in my company was shutdown before the I-140 approval. By that time the I-485 was pending for about 8 months. Now I am working for a different company and did not get a chance to send AC21 letter before the 485 approval, since the approvals(140/485) were concurrent. I am wondering if there would be any problem during the citizenship? I would be thankful for any sggestions.

Humm ... how much time did you spend inbetween jobs ? If little time, you should be fine IMHO. You didn't have time to file AC21, you are fine (I would think) in this sense. However, if you spent too much time with no jobs, technically you lost legal immigration status, and if you are interested on pursuing citizenship it could be an issue. I never remember exactly how much time you have to get a new job without losing legal status.

Anything could happen unexpected

I knew for long that FP2 will not get an updated status content, maybe just the LUD. But today, I received email notification, saying that my wife's 3rd FP review has been received, and processing of application has been resumed. Previously the content is always "... pending for review". Her second FP failed again(took on June), so got the 3rd one on AUG 10. It only took 3 days to get the result back to USCIS, is that amazing? I did my FP2 on the same day (although scheduled on early Sept, but I did it earlier), no updated at all.

What I am expecting you guys think?
