Still Waiting July 2002

I applied under outstanding professor and researcher (I-140) in July 2002 and am still waiting for a reply...

RD 10th July 2002
ND 13th July 2002.

Still no word, but USCIS wedsite says they are processing Sept 2002. Any one else in the same boat? I started a formal inquiry by having boss call the customer service site yesterday. Was that a good idea?

I was waiting to here back from I-140 before I filled I-485/EAD etc...but I think I'll just go ahead and file it now..I have everything ready to go, I was just wanted to attach copy of approval before I actually mailed it, so I dont go in the "concurrent pile"..any disadvatage of doing this or should I wait a few more weeks???

You are not the only one!

My situation is also similar to yours except that my I485 is pending since november 2002. Don't worry, there are many I-140 cases from May to August of 2002 yet to be adjudicated!!!

I too placed a case inquiry with UCIS.
Don't wait to apply for I-485.Do it right away or else your green card will be delayed further. In this thread I belive most of us have both I-140/485 either bending or approved. Are you happened to be from New York city???
Please let us know whenever you hear anything from UCIS.

The inquiry is a great idea, you could have done it quite a while ago !

As for being concurrent, I totally agree with Rajan, do it ... yesterday!. Six months after you file I-485 you can change employer, and I am not aware of any disadvantage of being concurrent, if anything I see advantages like the one I said, or the possibility that the Fujie memo will benefit you (see the lots of threads on this).

EB1-OR
I140: Oct 5 2002
I485: Applied Feb 2003, ND - Apr. 2003
Case Status for 485 shows
On May 20, 2003, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made.

With the new memo, I don't know if my 485 will be pulled to 140 date or 140 pushed to 485 date.

BTW, I think this thread represents a more realistic picture compared to the official processing dates..

Since your I140 is not approved yet, your I485 petition should be considered concurrent with I140 and both of them should be adjudicated together assuming your FPs and FBI checks have been cleared and are current.

Note that your Fingerprints will expire in ~3.5 months. Withing 3.5 months timeframe both of your petitions could be adjudicated at the same time.

If you do not hear from BCIS withing 3.5 months then your I140 will be adjudicated alone according to I140 OR timeline and you will be waiting for FP2 and I485 adjudication separately.

Please note that this is just my understanding of the recent BCIS memo and might not be correct.

Yeah, in fact since I applied, they pretty much remained idle for almost a year, and a few months back they started to go 1-1: to advance about once month of processing time per calendar month. I really hope they at least keep this pace, but they should really speed up to a 2-1 or 3-1 pace if they ever want to bring the backlog to something more reasonable (a couple months or so).
 
Update on my status and question

It seems that USCIS sent a notice on my I140. It may be a RFE. By the way, whom did they send the notice to? Is it myself, or lawyer, or employer? FYI, The application was done by a lawyer. Thanks,

As far as to my knowldge, in your case, it should go to your lawyer. When did UCIS put this information online? was it on 5th or week before or today! I am just curious! Anyway good luck with your I-140.
