**140 approval***

Congrats Lamhe.. hope ur good fortune smiles on the rest of us as well. Mendeita you next buddy!!

Lamhe, would you please share the details of your application with us. this will give us an idea of succesfull applicaitons. e.g. academia or industry? nos. of letters, any other unique stuff that made your application successful.

I strongly reccomend setting up an OR-485 forum. I am not computer savvy enough to set it up but will help in any way.

Barney! you know what! My wife's FP was also done on Feb2003!She also had the same problem as your wife! My Online status is same as your's and my spouse UCIS message is also same as your wife's!Except that we haven't received second FP for her??? I don't know what to make of it!!

My case is exactly the same as Rajan123, our FP were done ... I think November 2002 or so, maybe this is the standard message ? I'll ask my lawyer ...

Company closed...Pl. Help

I worked for a small company that is closed now. I am currently working for a big pharma. I had applied for EB1-OR through small company. They have promised me not to withdraw the I-140. I had hired the attorney myself and all the communication from USCIS goes to my attorney. I was wondering if someone got an RFE for EB1-OR, where financial documents of the employer were requested? What are the chances of getting this type of RFE for EB1-OR?

I am in academia (HIV research). My lawyer asked for 10 letters of Refs. I contacted 16 people (including NIH, NCI, Pasteur Institute, etc) and all 16 gave very strong letters of support and so he included them all (no letters from any of my immediate bosses, present or past and none from members of my same institute). I had a good publication list (journals with high impact factors in my field) and had also given presentations at prominent international conferences in US and abroad. My layer kept saying my application and CV are strong, although I still dont fully understand what a "strong application" really means - its all relative. I know of people who have made it with letters of support from friends and immediate collegues and with 1 or 2 publications!! - i suppose its mostly at the discretion of the person who happens to pick your file.

I have opted for Consular Processing (no I-485 or concorrent filing) - just to be done with all this sooner. If all goes well my interview should be in 6-8 months!!! i hope!

I haven't heard of an RFE wrt financial situation for OR, but since you are applying from a cmopany it might not be out of the question. Why don't you keep this I140 running and you send a second I140 from the new employer ? It should be easy. Also: I assume you are concurrent processing and you are using the portability regulation right ? (AC21 I believe it is). Otherwise you DO need to drop the old I140 anyways ...
 
Thanks for the reply. I did do the concurrent filing to use AC21, once I-140 is approved. In addition, I have an NIW application pending at CSC with CP option. My attorney is Sheela Murthy and their office wants me to wait until I hear back from BCIS, before sending in another application.

I think it is a wise decision, the likelihood of getting both:

a) your NIW rejected
b) a "bad" RFE on the EB1-OR

is as close to zero as it gets ;) Just relax and enjoy life in the meantime :cool:

someone's OR I-140 case approved (RD 04/12/02)

Hello,
Congratulations to those that have been approved.
I have been informed at my institution that one I-140/ OR with a RD on 04/12/2002 was approved recently (last week). I do not have more details except what I have indicated.
The liaison (contact) has just informed my lawyer that my case is "at Point of Contact for that case type". I hope that my long wait will pay off.

sINCE, THE PROCESSING DATES ARE WELL BEYOND THE 1 MONTH TIME FRAME, WHY DON'T U INITATE AN INQUIRY? just a suggestion... Since, judging by Lamhe and my Approval, they are proccessing Sept 25+ NDs.
 
My Case Approved !!!!!!!!

Guys, Gals, my I-140 is approved, the approval came to my employer on the mail !. Approved on June 2, 2004 :)

The weird thing is, online status hasn't changed yet !

Gotta go now, but I wanted to let you guys/gals know

We should leave it up to the liaison person. Anything else will delay the process. I initiated the inquiry through the liaison. That's how we found out.
