Hi everyone, a while ago I have posted an excerpt from our RFE, we got RFE in August. Sent reply on October 1st, received approval dated October 24th. Just wanted to share that info with you. Original petition was filed on April 26, 2002 for extraordinary ability category. They needed more info to approve this category, however approved NIW without any additional info!

My sponsor has just called for me this morning to inquire about my I-140 which was sent on May 31st, 2002 (OR petition). Both INS people that were contacted responded that they are processing May 28th, 2002 I-140 cases. They suggested to inquire again within a month if there is no answer by then. I find this strange that they would cite the date of May 28th, 2002, when the time processing table says that they are up to June 10th, 2002.
I applied as an OR. My application is now few weeks past the 485 days limit: 543 days to be exact.
I just went past the date of my concurrent filing (I-485) on Nov. 19th. So the theory that was floated here does not apply to my case. I know it is just a theory that had fostered some hope.
I would like to hear your opinion on this. Thank you.

mzgh - thanks for posting the update. It means a lot for those OR's who are waiting for >485 days. My guess is a few officers are working on 6/10/02 cases but others are still evaluating 5/28/02 cases, so BCIS choses the later date in their reports.
RD 5/29/02 continuing to wait patiently ... Also due to company policy, have not applied for my I-485 either, so there's a huge disadvantage there!!!

Since the processing time is now official, they should clean up all the cases left before 06/10/02 - 30 days = 05/10/02, such that they can do what they promised to do on their website. Am I right? our laywer tried to place another follow-up inquiry today, but she said apparently VSC is processing cases around 5/18/02, so she has to wait another 30 days until a new inquiry can be placed. I hope this time they are really opening our cases...

They also said to call in a month. I think that these are operators that probably were reading the official posting that we all have access to. They were not at the Vermont center. Do you guys know how to get access to a live voice at the Vermont center?

Is it fine to work with EAD (renewal) receipt
Hi guys
As you see from the postings that my case (RD - Feb 22 2002) is still pending. Got RFE on Sep 05 and replied around Nov 16 and they received it on Dec 01 2002. As seen from other postings it it takes about 3 - 4 weeks to see any change.
Amidst thanks giving vacation, snow storm, christmas holidays
it is hard to predict anything. My EAD expired on Dec 03 2003 [ I applied already for renewal (RD date is Sep 27 2003)]

I hope to get my EAD by Dec 27 2003 so that I can start working from Jan 2004. (I already have an offer but waiting to
get my EAD). If not I have to get an interim EAD after 90 days
(which would be Dec 28 2003).
In this situation, I don't know if it is OK to work with the EAD receipt. Will the EAD renewal period be still Dec 03 2003 - Dec 03 2004 or will it be from the date of approval?

Officially you have to have a card. And that what USCIS says on phone too.
But it mostly depends how strict are your Human Resourses.
I had to take an unpaid leave for 4 weeks till my plastic card arrived and they did not care about any receipt notices.
Renewed EAD expiration date is usually one year from the expiration date of original one.

I do not want to discourage anyone, but if there is an RFE pending for your I140 case - it might be difficult to get a new EAD card issued.
Service center will not issue EAD till RFE reply is received and reviewed , and your local processing center (if you go ther after 90 days from submitting EAD renewal request) might say that due to an RFE they are unable to issue you an EAD card. I think somebody described similar situation on this forum.
