EB1- OR: please update your info.

No interim EAD if any RFE? Is it true?

Hi

Gegemon was mentioning that the local office will not issue interim EAD if there is any standing RFE. I don't know if this is true or not. My EAD expired on Dec 03 2003 and I applied for renewal on Sep 27 2003. (I had an RFE and the reply to that was received by BCIS on Dec 01 2003). So far I have not heard anything about my I-140, EAD and AP. As a general rule it takes roughly about 4 weeks to get some answer I am waiting for that.
If anybody has experience in getting EAD with a standing RFE,
please post it here. My situation is little tricky too. I am having an offer and I haven't taken it because my attorney suggested me
to take that offer after I-140 approval. (new readers please go through my previous postings in this thread).

Pending EAD

I have this situation. My 140 was pending since March 15 2002. I did apply for EAD RD was 9/2/2003. I think my application activate my pending 140. I received RFE on 9/19/2003. My attorney send RFE and RD was 12/18/2002. My EAD now is pending for more than three months.

Another month have passed. The processing time remains the same on 6/10/2002. Called 1800 again and they said unless the posted date is 6/18/2002 (30 day window of our receipt date-5/18/02) we could not place any inquiry. And that processing date has been 6/10/02 for 2-3 months!!
I think they are not doing anything but making new rules and excuses.
 
no news still - almost going to be two years

Hi EB1 folks

I am wondering why VSC is still pondering over my case for such a long time. By next month it will be 2 years and must be close to
a record. My I-140 RFE was dated Sep 05 2003 and the reply
received by BCIS on Dec 01 2003. Still no response to my case.
People report that RFE cases were approved within 2 - 6 weeks from the RFE receipt date. Mine is more than 7 weeks. Because of this my EAD renewal and AP are pending still. (But I got my interim EAD 10 days back from Boston office).

Is there anybody waiting for approval with a replied RFE?

Hi Sekar

I am 2 weeks behind you. My RD is 3/15/2002. I applied for EAD on 9/2/2003. I received RFE on 9/19/03. They received my attorney reply by 12/18/2003. I am waiting for you approval. Because mine would be 2 weeks after yours.

I am little worried about the status. Somehow things are going weary in my case. There is no logic behind anything with regard to RFEs but still BCIS wants something as a reply which kills
precious time on everybody. There is no such forum to complain and if we do so they can take out some loop holes and kick us out as " case denied". I don't see any reason that somebody is sitting on my file for almost two years without doing anything.
Sounds vague!!! YES this is how BCIS is...

As long as we hold our jobs it is fine. It becomes annoying if we loose our job before I-140 gets approved. This happened to me and again I am on track.

Even after all these complaints, I am still hoping that I will get
the approval this week.... Too positive... is it not?

As somebody mentioned that only those guys who lie gets approval faster than those who genuinely advocates truth.
Truth will finally triumph are hard to digest as far as BCIS is concerned.

I-140 approved almost after 2 years

Hi guys

It is really a surprising that today I saw my I-140 got approved almost after two years (Feb 22 2002). I hope Mo_99 and Gegemon get their cases approved soon along with others pending for more than 18 months. I got RFE on Sep 05 2003 and the replied received on Dec 01 2003. After 50 days (7 weeks) the case got approved.

Gegemon : I already got my interim EAD on Jan 9th 2004 at Boston local office and it looks like RFE does not seem make any difference. Probably for those who are applying EAD for the first time, it might. But mine is a renewal and it went through fine.

I got laid off in Sep - Oct 2003 and I got a job in Nov 2003 and
I didn't take it because of pending I-140 (though I-485 was over one year). I am getting offers in January 2004 and the timing of my I-140 approval was so perfect since my offer letter from a company is due tomorrow and planning to join this week or next week.

The previous posting in this thread is from me and you can see my frusturation and I was still positive that mine would get approved this week and it did so.

I see some postings in the I-485 forum that there are approvals
dated August 2002. Personally I know one of my friends friend who got his I-485 approval last month with a RD of Aug 2002.

The band is so long that cases are approved anywhere from Jan 2002 to August 2002 ( 8 months band). Mine is Sep 2002 and who knows these guys could approve randomly cases filed in Sep 2002.

This forum is so good and accomodative and hope people get their I-140 approvals quickly (it is frusturating to see people getting their I-140 approvals with RD date of June - July 2003).

Hi Sekar,

Congratulations on your I140 OR approval! This is a good news after so many months of no activity in EB1 category from BCIS. I will wait for two weeks to whether my theory is working or not. :confused:

Along with I-140, EAD also got approved

Hi guys

My EAD which was pending for about almost 4 months got approved on the same date along with I-140 approval. This shows that my EAD was held because of RFE in my I-140 case.

Mo_99 : Hi Mo , I think yours will follow within a couple of weeks.

iEAD renewal, good for 8 months

Hi,
The processing date has been moved up to June 25th, 2002 for EB12 (OR) and remains the same for EB11 (June 7th) for those of you that are still on this list and waiting like me.

I am still waiting. I got an iEAD in Boston on february 22nd (1 hour at the office and 1h30 mn waiting outside (5:30Am in Boston). It is good for 8 months. I urge you to set up an appointment so that you can use the side door at 7am like some smart guy did (not me). You can use the side door if you have a notice that says that you have an appointment (notice?).

Otherwise, i was not updated on my case. I am counting on 21 months waiting now. They still say wait till the window moves to past June 31st to start an inquiry.
I hope you guys are luckier.

Just watching this thread to see if any approvals for my fellow guys waiting for such a long time. As you know mine got approved almost after 23 months. After I-140 approval my
EAD got approved on the same day (Jan 20 2004)and after three weeks my AP also got approved (Feb 13 2004).
My AP and EAD RD date was : 27 Sep 2003.
My first Finger Print got over on Nov 18 2003.

My attorney says that he received few I-485 approvals for his clients with RD dates in Sep 2002. Mine is Sep 27 2002 and he
said that he would not be surprised if my I-1485 gets approved any time from now.

When is your finger print done? If already done, you can also
get your I-485 approval soon. Let us hope for the best.

I see mo_99 still waiting for I-140 approval. As per speculation one can expect faster approvals because of the load taken off
through H1B cap which freed some BCIS resources.

I hope what you say is true. Thank you so much for your support. I hope you get approval of your I-485 soon.
My first (and only so far) finger printing was done: Feb. 12th, 2003, 42 days after my first EAD and AP (Walking: Dec. 30 th,2002).
My lawyer had told me then when I applied for concurrent I140 (05/31/2002) and I485 (11/19/02) that this will delay the decision on the I-140 by 12 months (assessment of Summer 2002). In December 2003, he said that I-485 process takes 24 months (including the I-140 waiting time).
So now i am on my 21 MOnth wait for I-140, and
15 month wait for my I-485.
- Waiting is my only solace and recourse.

still donot know whats happening.
Got 2nd EAD approved in nov, they had put wrong dates so got it corrected a month ago, thats the only status.
