EB1- OR: please update your info.

another RFE

Just check the online status, noticed that there is one case filed the same day as mine got an RFE today (7/31). Like someone else here, I also monitor 6 close EAC numbers. The good thing is that they finally took a look at a file close to mine .... but don't know what will happen to my case .... so nervous !!!

approval date : July 18, 2003

The main problem they found was with recommendation letters. I submitted 7 letters- 4 from USA and 3 from Canada, Germany and Sweden. They replied: The letters of recommendation you submitted are noted. However, is beneficiary considered to be at the SAME level as the authors of the letters of recommendation? (Those who gave me letters are professors, section chiefs and a director of an institute.)
Conclusion: it has not been demonstrated that he belongs to an elite group of other individuals who have also reached the very top of the field as well.

On the other hand I presented inventions, on which I am a co-author and 19 publications out of which I am on 11 is first author.

I put everything together pretty much carefully and had documents lined up logically. I have several inventions, that were filed by my lab chief. My name is the second. As a proof that I am major contributor to the invention I presented a first author (my name first) paper in top journal describing the invention . In addition I presented letters from collaborators, stating that I am a major contributor to the invention and describing how extraordinary I am and how important my inventions are. Additionally I add to the list several inventions supported by publications where I am just a co-author.
So, what do I get in response:
The beneficiary has gained a certain amount of recognition among his peers and the scientific community in general. The inventions in which he has been INVOLVED are noted along with his publications, invitations as a speaker, poster presentations, and contributions to his field. However, it must be noted that he is NOT NAMED as the principal inventor but rather is named among several other individuals. The same applies to his poster presentations, publications, etc. While it is noted that scientific research is often a collaborative effort, it must be shown that the beneficiary stands out amongst his peers and has reached the very top of the field.
I do not understand how else you prove your first authorship. Send them my lab notebooks? Just kidding. I will ask several more experts to write letters. And will resubmit them. I am not decided yet if I have to hire a layer.

I think the reason we could not keep a thread like this to survive longer is because we rarely have any good news and it is too long to wait ... very frustrating ...

08/07/2003: I-140 to Experience Slow-Down for Next Two Months

The special immigrant petitions for religious workers (I-360) other than minister category and related I-485 cases need expedite so that these cases be adjudicated before the law sunsets at the end of September 2003. Under the exigent circumstances, the BCIS decided to expedite these cases. The Service Center sources indicate that the adjudicators who are currently working on I-140 petitions and related EB-485 applications will be taken out of these product lines and swiched to I-360 and related EB-485 product lines, with the resulting delays of adjudications for I-140 adjudications for the next two months. As this reporter reminded people so many times, immigration agency decision on prioritization always produces winners and losers. It is the fact of life in immigration business.

New Processing Time at VSC

Hi, guys,

The latest processing time for EB12 keeps moving forward, now it is 06/05/02. Although it might mean nothing unless our cases get actual approval, still it is better than nothing. Wish we can see more approvals ....

Looks like EB1-EA April 02 cases are being processed - based on the RFEs recieved recently by alexk and citrusfrost.

However, I have not seen any EB-1 OR approvals or RFEs recently. Is it that EB-1 OR cases are being singled out to be ignored by VSC?
 
EB1-OR no news

Sometimes I wonder the justification for higher education - as VSC does not seem to recognize this OR category !!!

it looks like some folks got their approval earlier although thety filed later based on the scheme we created. Don't see any logic there although I am very happy for people who did get approved ahead of time!
 
Here is an excerpt from the RFE:
"If you are willing to change your request to second-preference " advanced-degree professional" classification with a national-interest waiver, we are willing to approve the petition for that classification, with no additional evidence of any kind. Such a change would produce no disadvantage to the beneficiary in his pursuit of permanent resident status. Please let us knowwhether you are willing to change your request to second-preference advance degree professional."
