DV 2026 AOS (Adjustment of Status) Process Only

Interesting that you found someone who had attended the interview. I know AOS cases are rare, but I haven't seen much evidence of interviews being conducted since the hold started.
I faintly recollect reading about one DV selectee on your blog who reported a while back that they attended their interview back in December, after the pause went into effect. The IO told them they could not be approved due to the pause, and effectively put them on AP.

Yes - that's about the only other case I know of - and there are people who are presumably waiting...
 
Hello Mon, just an update. I went to the ASC this morning, and the staff told me that when they scanned the barcode, USCIS only required my photo and signature, not fingerprints. They also said that Code 2 means photo and signature only, and they cannot capture fingerprints if it is not indicated on the barcode. The staff mentioned that if USCIS needs my fingerprints, they may schedule another biometrics appointment.

Additionally, I talked to a DV selectee who attended an AOS interview last month. The DV selectee mentioned having the same issue. The ASC staff did not capture fingerprints during the biometrics appointment, and during the interview the IO said they did not have the selectee’s fingerprints and captured them at the interview.

what field office was this? would you be able to ask that DV selectee whether their interview was scheduled before or after the pause?

The field office is in Las Vegas. On December 18, USCIS was ready to schedule the interview. On December 30, USCIS scheduled the interview. The selectee attended the interview on February 3.
 
Thank you so much for your advice. I'm just completing my DV AOS packet and will be sending to USCIS tomorrow. For PERM certification, since there is six months for submitting I-130, we are planning to wait a bit and see how the DV processing goes, if not moving or anything happen then we will do EB-2, is this a good straategy?

the strategy is reasonable - it would be the best in a low- or no-volatility year. I'd also say that you may want to pay attention to the Visa Bulletin. (E.g. from personal experience: because we were expecting the Priority Date to become current soon, we didn't wait long to submit i-140 after PERM. Given that VB Action Dates sometimes regress for EB, we wanted to seize the opportunity before that happened. I guess the agency has plenty of time at their hands now so that was oddly approved in just 4 days.)

does the passport have to be valid for another 6 months when applying?
We are current in April. German Citizens. Our passports expires in June 2026.

I wanted to get an appointment at the german embassy in miami but they are saying that it takes 3 months to get an appointment. And then who knows how long it takes to get the passport.
We already sent the DS260 to KCC but not yet the I485 to USCIS.

  • Is that a problem for AOS?
  • Should we try to fly to Germany and get it done or is there a chance that they will not let us back in because we submitted the DS260?
  • Our oldest son will turn 21 this august. Can he stay, once we submitted the I485 or does he have to leave if we do not get the GC before his birthday?
  • and unrelated to that: We are supposed to fill out every blank with "N/A" really every single one? Or just the first out of each question. And once I downloaded the PDF it does not let me use the "/". Same with the Number 2 where it asks for our current status.

1. There’s no six month validity requirement for the passport as of when applying for AOS. You however will need an unexpired passport for the interview, so start the renewal process.
2. Admission or readmission to the US is always at the discretion of the CBP.
3. He’s allowed to remain in the US while his AOS application is pending.
4a. Take a look at the sample pre-filled I-485 form for expectations on how to fill the form. The sample pre-filled I485 link is in the AOS process spreadsheet.
4b. You have 3 options for addressing this.
- You can omit the slash sign (/)
- You can hand print the response (using a black pen) in the sections with the slash sign
- You can disable Java Script in Adobe prior to filling out the form

The Department of State has made an entry into the Federal Registry yesterday, outlining key changes to the DV-2027 DV Lottery (Effective April 10, 2026) such as Unexpired Passport, DoB, $1 Fee e.t.c.. I personally hope that these were the changes that initially caused the DV pause to the bigger extent, although, do we have any information on how this will affect the DV-2026 and specifically, AOS individuals?

There's no reason for the new entry requirements to impact current selectees, the requirements will not be retroactively applied. We've known about the upcoming changes to DV-2027 for a while now, long before the current DV pause went into effect.

Sorry, I may have worded it confusing - I was more so asking if the finalized decision to implement them and open the DV-2027 will somehow affect the current DV-2026 pause, or have it potentially lifted. But I guess we should see these DVs as completely separate. Thank you!

Reasons for the delay are separate and unrelated to the reason(s) given for the pause. We'll just have to wait and see.

Simon has a great write-up on his blog titled Where is DV-2027? which has a detailed timeline on the reasons for the delay and when the pause came into effect. You might want to take a look.
