DV 2025 AOS (Adjustment of Status) Process Only

Thank you. Should I mention the situation of be being the Derivate of my spouse, and that it’s Diversity Visa?

Also I am planning to go to the field office this week with another printout, I want to explain the situation and see what they say. Would this be contradicting with the congressional inquiry?

Deadline for the RFE is in 2 weeks.
1. Yes indicate it is DV based. Who was the RFE addressed to?
2. I’m tired of answering questions as to if you should visit your FO in person or not in response to the RFE. You’ve asked this question a couple of times in the past, and you haven’t once updated us as to if you went or not after the question got answered.

1. Addressed to me (derivate). In the first sentence, I will briefly explain that my spouse is the DV selectee and I submitted my I-485 as her derivate.

2. My apologies. I planned to in the past but again decided to exercise patience as advised.

I will submit the congressional inquiry and visit the field office this week and keep you posted of course.
 
Hello again. I have a question if there is anyone who knows any information about Lewisville and Dallas Lockboxes.

On the spreadsheet it says some lockboxes may reject early filing erroneously. For Texas, there are two options, either Dallas or Lewisville. Do you know which one is better in terms of accepting the early filings? Are you familiar with any previous cases?

I came to the United States in August 2021 on an F1 visa with a 5-year status. In November 2022, I married my spouse, who is a DV Lottery winner and a lawful permanent resident (LPR). Until I received my work permit, I maintained my F1 status, and my EAD card arrived at the end of May 2023. During my time in the U.S., I have never been out of status. My marriage-based I-130 was approved in August 2023, and my Advance Parole (I-131) was approved in January 2024. For my green card (I-485), I am currently waiting for my priority date to become current in the visa bulletin, as I am applying as the spouse of an LPR.

I am also a DV 2025 selectee with a case number in the 25,000s. Since I am already in the U.S., I would like to pursue adjustment of status (AOS) for my DV Lottery case as well. However, because my case number is not yet current in the visa bulletin, I have not completed the DS-260 form.

Would it be possible for me to open a second AOS case for the DV Lottery while my marriage-based AOS case is still pending? What steps should I follow in this situation?

1. It is possible for an applicant to have multiple AOS applications in the system at the same time. However in your specific case, since you technically have no valid status per se (as you’re in what is commonly referred to as AOS pending) to AOS from, I’m not quite sure as to what the outcome of your DV based AOS could be. Usually when an AOS applicant is in a pending status, usually a COS, the COS application would need to be approved first before the AOS application can be approved.
2. Same steps as any other DV based AOS applicant if you wish to proceed with processing your DV selection via AOS.

1. Congressional inquiry on my behalf was made by the congresswoman’s office.

2. walk in was unsuccessful - security guard said everyone is in appointments and I didn’t get to talk to anyone or hand the documents. Kept telling me to get an infopass appointment if I wanted to talk to someone.

I am also not surprised but still wanted to try everything. Looking at past spreadsheets, quite a few people were successful with walk ins. Maybe too early or am I missing out on something

1. Nothing happens to your EAD (assuming you have an existing EAD) if you file for AOS. It is not true that you cannot file for CPT after filing for AOS. Ideally, it would be better to already have CPT or OPT in place as the case may be prior to filing for AOS, however this can still be applied for after filing for AOS.
2. Early filing simply means you an applicant can send in their AOS package earlier than the first date of the month in which their CN becomes current which gets it in line for processing, earlier than an applicant who decides to what until the first date of the month they become current before filing. (This explanation is based on both applicants having CNs that become current in the same month).

To add to what mom said. It doesn’t “sit there” for 2 months. Uscis doesn’t open and act on things the day they get them. It goes to a lockbox , takes a few days to get opened, put in the system, assigned to a FO, another inbox for them to get around to looking at it, stuff needs to be requested from kcc, background checks get done etc etc all before you get put in line for interview. The point of early filing is so that all that stuff can get out of the way and you are not getting “current” time wasted on that, especially useful for people who get current late in the FY.

Another question I had is if I do AOS and get denied or RFEd and as a result it takes too long - can I then switch to consular processing? If I get into administrative processing with counsular processing can I still change to AOS?

If I pay the $330 DV Fee does that automatically trigger AOS and I no longer get an invite for interview from my embassy? I would like to first see how fast I get an interview invite but if I then end up doing AOS I Ideally don't want to have a delay from having to wait to get the payment receipt for the $330 fee and would if possible already want to get that out of the way now..

If you’re going to change from one to the other you should do it before you are scheduled for interview. It might still involve quite some admin your part to get the change done. KCC handles it until you notify them you want to do aos at which stage your case is in the hands of uscis, or until you get scheduled for a consular interview at which stage your case is transferred to the consulate. Changing it then requires you to be dealing with the consulate and uscis rather than kcc doing that admin for you as they no longer have your case. There is almost no way you’ll avoid a delay in the process if you decide to change. Some consulates are not particularly responsive too.

At this point, I recommend you go through the FAQ section of the AOS process spreadsheet.
 
Hello everyone, What happens after the ead is approved? Will my F-1 status be revoked? As my F-1 status will be expiring soon because I cannot file for stem opt.
Should I apply for H4 to have a fallback status? What will you suggest? Or should I consult with a lawyer?

My husband was selected AF202548*** ,so far what we've done is the medical form.Should we pay the diversity fee indorder to get the 2NL?
