DV 2024 AOS (Adjustment of Status) Process Only

hi @Sm1smom, I did a congressional inquiry with my congressman, and they said it would take around 2 weeks to get a response, it's been more than 3 weeks. Should I contact my congressman to see if they got a response or is it normal that it takes more than 3 weeks/a month? thank you, best regards.

Yes, reach out to them to find out if there's been any update on the request they submitted.

The NBC is responsible for processing and approving the AP - this is covered on the AOS Process Spreadsheet. When did you send in your AOS package?

The package was sent on April 12 and delivered on April 15, and the money orders were cashed today, May 1.
So, now that my Lockbox is in Chicago, do they mail my papers to NBC in Missouri? Or is it an internal scanned process? I'm just counting down the days. I hope the timeline is okay for receiving a positive answer.

I have no insight as to how the files get transmitted. You can take a look at the Lockbox_NBC_FO tab of the AOS Process Spreadsheet though.

Based on your above timeline, highly doubtful you'll be receiving an approved AP on or before the end of May. Does the travel plan involve a life or death situation?
 
I am F1 OPT Student applying for AOS based on DV immigrant category. What would be answer to this question "Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?"

No, it does not. It is more related to
  • Nonprofit organization (as designated by the Internal Revenue Service (IRS)) whose request is in furtherance of the cultural or social interests of the United States;
So, it is more like a pressing or critical professional need.

For this category, you do realize it is the impacted nonprofit organization that is expected to file the expedite request and not the beneficiary? Anyway, hopefully you have the applicable documentation to back this up. If there's no update re the expedite request by the third week of May, you probably want to look into getting INFOPASS appointment scheduled via Emma chat to enable you visit your FO with the documentation (and your NOA) to request an emergency travel document.

NOTE: According to USCIS , not every circumstance that fits under their listed criteria or examples will eventually result in expedited processing. The decision to expedite is within the sole discretion of USCIS.

Great point, Mom. I had not considered it before because the AP was submitted with the AOS Package. So, it is excellent advice; I will do that and talk to my Non-Profit employer. Yes, we have all the documentation and already sent it attached to my application.

This is a specific question but maybe there are examples on this forum. I gave biometrics at a USCIS ASC for getting a Canada tourist visa 3 years ago. Is there a chance USCIS can reuse my biometrics from that time?

That was a Canadian mandated bio collection. I do not think USCIS will waive your bio capture on that basis.
 
So I had a conversation with someone and they mentioned, Any field office with your case can approve your green card even if they do not have jurisdiction over that case. In the sense that, if everything looks good (document wise) and visas are available, any field office can go ahead and approve the case since ( NBC has the overall jurisdiction). However, they only transfer to the specific field office with jurisdiction when an interview is scheduled (if they realize the new address during the interview) or they are about to schedule you for interview and they realize they do not have any jurisdiction. I’m just curious how true that is. If anyone has insights. Sorry to bother

The I-134 should ideally be filled out by a USC or LPR residing in the US.
 
Hi mom, because my wife used to receive some government benefits such us Rental payment voucher and SNAP (card to buy food only) she never received cash only voucher, the question is must she write this voucher value to the table 68.c
