DV 2023 AOS (Adjustment of Status) Only

Hi Mom,

My daughter is a DV2023 winner and is currently in the US on F1 Student Visa (STEM Field). We are 100% contributing to her financially. However, placed a substantial deposit in her US account. When filling out I-485, there is a question on Public charge. "Are you subject to the public charge grounds of inadmissibility under INA section 212(a)(4)? should she answer Yes or No?

I would like to hear from winners who have already filled I-485
Every single DV based AOS applicant is subject to the public charge grounds of inadmissibility under INA section 212(a)(4), so the correct response to that question is YES. This was previously discussed here, here, and here.
 
First, I am going to say that take this as just an advice and not a legal one. My understanding on the public charge grounds as defined by USCIS is that if you have received financial help/grants from US organizations such as IRS (Stimulus Check), State (SNAP,) just to mention a few. So, I would have chosen no because these financial aids are not from US institutions but instead from my family who aren't even in the US. But like I said, it is my opinion and not a legal advice. There are more experts in these forums that can add to this discussion.
That would have been the wrong response. The question is not asking about if you've received any of those or other government benefits. Being "subject to" is not the same thing as "having received" public benefits. And receiving the IRS Stimulus Check by the way, does not constitute being a public charge.

I am an F1 student living with my sibling in one apartment. We live as roommates where each one of us is responsible of their own expenses. As I fill my I-485 (Public Charge-Q62), would my household count as 1 or 2?

No, your household count is 1 based on this.

does paper size matter when filing? I have a few translated documents in A4 size and don't know if they accept different paper sizes.

Hello, l received a rejection notice for my AOS but the problem is all the reasons they stated for rejecting my AOS l double checked and l had everything done. for example they said my application didn't have a signature but its signed, they also said l didn't complete the section of application type but l checked that too and it was completed (l marked the diversity visa box) then the other reason was that l submitted an outdated version of the form but that's not true l submitted the new version. lam perplexed! l don't know exactly what to correct since everything they mentioned was done correctly the first time. Is this normal? l did not submit my medical exam report with the application, could that be the real reason it got rejected? l had read that it was not necessary to submit the medical report with the AOS since l can bring it to the interview. What do you think? l would really appreciate any insight on this matter because lam truly confused.

I can take a look at your rejected I-485 and the rejection notice if you're comfortable enough to share those privately - having a second pair of eyes review sometimes helps.

We are here in the US on a G1 visa.
Do you think we should still AOS regardless of the high CN?
Attached is the latest correspondence received from KCC.

I'm sorry I cannot tell you guys if you should proceed with processing AOS or switch over to CP. That is a decision you you'll need to make on your own. I do encourage you to take a look at the Pros & Cons section of the AOS Process Spreadsheet, and based on your personal situation and circumstances, that information should hopefully help you make the right call.

This is like asking how long is a piece of string. There are myriad reasons that could lead to a rejection.

Anyway, some (note: not all) common reasons could be: using outdated forms, sending incorrect filing fees, sending application to the wrong Lockbox, failure to sign the right section of the form(s), credit card transaction failure, bounced check, missing page(s) from the form(s), failure to clarify basis of adjustment, missing required supporting documents, early filing (which is an erroneous rejection), etc. There's the one I call "going N/A crazy on the form" - this happens when an applicant decides to fill all the sections of the form that is not applicable to them with N/A, including the Preparer and/or Interpreter section (while the signature parts of those sections are left blank). It could also be pure bad luck - as in package rejected for no clear reason, or the package is reviewed by a new employee is not quite sure of what to look for.

I guess I wanted to know what your experience is with those having a high CN from OC that AOS, do they get a GC?
I was selected in 2021 with the CN 2022OC23** submitted DS160 in June 2020; and from July - September 30 2021 when we kept enquiring with the responsible embassy in Europe they kept telling us that the CN was not current, they said they have not heard from KCC to issue 2NL, then they said they they did not have the capacity to process our visa request. We missed that opportunity andI do not want that to happen again.

I'm sorry you guys missed out on DV2021, but I still cannot tell you which option might be best for you. I however do suggest you also take a look at some of the past Timeline spreadsheets in that case - you'll be able to see/read about the highest AOS OC CN reported in this forum.

p.s. just to be clear you submitted the DS260 and not DS160 form, correct?

I am a selectee from EU , I did put my country of birth Uzbekistan, and I am a citizen of Azerbaijan so I put country of chargeabiliry Azerbaijan based on where I lived . So now one of family member told me it should have been Uzbekistan. I am currently in USA and I was planning AOS since my number is current . Will I have issues due to that mistake I made

2. For evidence of financial support should I attach only one or all of the following? Recent Bank Statements, Recent pay slips, W-2, Most recent IRS tax Return Transcripts

I am a selectee from EU , I did put my country of birth Uzbekistan, and I am a citizen of Azerbaijan so I put country of chargeabiliry Azerbaijan based on where I lived . So now one of family member told me it should have been Uzbekistan. I am currently in USA and I was planning AOS since my number is current . Will I have issues due to that mistake I made
Your relative is right, your chargeability country should have been listed as Uzbekistan. Your country of residence or your citizenship country has no bearing on the entry form. You're however fortunate as both countries are within the EU region, so you shouldn't have an issue with that error (IMO) as long as your file based on the Uzbekistan cut-off number and not based on the rest of Europe since Uzbekistan is in the except category while Azerbaijan is not.
