DV 2023 AOS (Adjustment of Status) Only

Hi Mom,

Just to let you know, my husband received a letter of denial :(
It was a few pages long but basically stated that he was in status and that reason for denial was visa exhaustion.
Again so upsetting as we've been jumping through the U.S visa hoops for 10 years now. And we were also one of the Aussies that were stuck here for almost 2 years while our country locked us out (without work visas and constantly filled with anxiety we would end up with an overstay on our records) and then finally had to move to Mexico for a year as Australia still hadnt opened borders. We thought this would finally end the nightmare. Oh well, at least I have mine as you said...glass certainly half full. A few quick and hopefully easy questions... Thanks in advance!

1) Is it weird if I immediatley send the I-130 petition in after receiving my greencard so soon?
2) How many passport photos are needed if submitting both I-485 and application for EAD?
3) Will they scrutinize income more since it is no longer a DV application?
4) Do I need to send in an affidavit of support with initial application, or can bring later to interview? Or substitute a bank account balance showing savings instead since I only just got my greencard and do not yet have a job or a W2?

How comes Australia is locked, the border is open and any Aussie is welcomed to return home.

I'm sorry to hear of your struggles. I'm Australian also and been here for 7 years. I looked on the spreadsheet and trying to understand your situation.

1. Was there a reason for the delay in submitting your documentation - you paid the fee in June, but were current in April?
2. How did you get approved for green card but your husband didn't? Weren't you interviewed at the same time?

Sorry to learn of the inevitable outcome of your husband's application.

1. Nothing weird about that.
2. You will need to read the instructions for each form and ensure you send in the applicable documentation (including required number of pictures) with the application.
3. Scrutiny level for not being deemed a public charge is the same regardless of it the AOS application is DV or family based. However, the required documentation for ensuring that is a lot more stringent for a family based AOS application.
4. Please spend some quality and review the instructions regarding what is required carefully yourself.
 
Hi Mum, If incase (by any chance) we got our case approved and card being ordered before September 30. Will we get our card after Sept. 30 as well?

Cases can be approved until Sep 30. It can take up to 4 weeks for postal delivery.

That's how it is supposed to work. But with the visa exhaustion, there should be no more new approvals. What are the reports about new approved cases? It may be an officer's error that may get overturned, might have been approved already, and just not updated in the system. Who knows!

Bottom line, no point in speculating.

The GC can be received on, before, or after Sept. 30th, it really doesn’t matter. The date that matters with DV based AOS application is the approval date which cannot go beyond Sept. 39th of the applicable FY.

Okay. I got approval letter and status was updated to Card was Mailed to me last Friday.
Never loose the hope guys. :)
 
so as I understand, some of the people who had their interviews before September 7th, has their GC approved, but no on eater that date. is this right?
is there anything that a congressman can do at this time?

If possible try using congressman, at least congress could get reports regarding to position that AOS cases are stuck with.
