DV 2021 AOS Only

To those who are going through I-90 for replacement cards,

I had my last and first name swapped on my initial GC. I filed I-90 immediately in September 2021. First forward, At the end of November 2023, I had my application approved and received the green card with the correct name. It took 26 months in total.

In the meantime, I was using the incorrect GC for the entry. I had probably entered the country for more than 10 times and NO ONE noticed that my name was swapped on the card so overall I had no issues with it. The only thing is that I could not apppy to global entry since they do verify the name on passport and GC. That’s about it. Hope this is helpful and good luck!

I also had applied for I-90 in September 2021 cause our daughter's date of birth had a typo. She did her bio-metrics in October 21 and at the end of October 2023, we received her new corrected GC. It took 25 months to get the new one but unlike you, we didn't travel.
 
I have a question for those with pending asylum cases who got selected for the DV and managed to process their AOS successfully. What RFE did you give that justified your extended stay after your status expired? I know some people argue Matter of Orban which can be a grey area. Aside from "claiming USCIS" did not process a claim in requisite time, what other RFE was used?

Hello everybody!!!! Today is an incredible day. In the morning, the postman brought a letter containing white cards - an approval for the interview of my husband from San Francisco. At one o'clock in the afternoon, our officer from Sacramento on the Green Card himself wrote to us and asked if we had an SSN, he filled out the documents for us and wrote that he approved our green cards and they will come in two weeks. Two positive results on the last day, isn't this a miracle of God? I am grateful to all of you and grateful ritallight, MorningmyGC@7

I came across your post about being granted a Diversity Visa (DV) while your asylum application was still pending, and your situation sounds very similar to ours. If you don’t mind, I would really appreciate any advice you could share on how you applied for Adjustment of Status (AOS) as a DV winner, and what the ideal timeline is for doing so.


My wife and I are asylum seekers from Myanmar. She is the principal applicant in our asylum case. We entered the United States (New York City) on visitor visas in August 2024 and submitted our asylum application in October 2024—while our I-94 statuses were still valid.


As of May 2025, my wife has been selected in the Diversity Visa Lottery. However, since our I-94 statuses have now expired, we’re concerned about whether we still qualify for AOS under the DV program and how to proceed, given our current status.


We would be very grateful for any insights or guidance you could provide based on your experience.
