DV 2013 disqualification because of a child issue

Acceptance of DV-related I-485 Applications During 90-day Period Preceding Cut-Off Number in the Visa Bulletin

DATE: 19 JAN 1999

This memorandum is being issued in order to ensure uniform processing of applications for adjustment of status under the Diversity Immigrant (DV) category.

Section 245 of the Immigration and Nationality Act (the Act) requires that an application for adjustment of status may not be filed until a visa number is currently available. Recently, the Department of State issued a memorandum advising the Immigration and Naturalization Service that each month it would provide the cut-off numbers for the Diversity Immigrant category 90 days in advance. This advance notice is being provided to allow the INS additional time to process the background checks for DV applicants.

All offices are hereby advised that applications for adjustment of status filed under the Diversity Immigrant program may be accepted for processing any time during the 90-day period preceding the cut-off date provided in the Visa Bulletin. Offices are advised, however, that while the applications may be accepted for the processing of background checks and scheduling for interviews, visa numbers will not be issued until the cut-off date is current.
Other than that you got it. No restrictions.
 
Actually, DOS found a way to screw up his upcoming application nevertheless even without having jurisdiction over his case :)
Out of luck. They destroyed his luck just in 2 days and they also destroyed a perfect test case that would illustrate the point. How powerful they are and just because of one person! Amazing!

Clearly.. You're trying to post as many arguments as possible even though they dont support your theory. "Ask the guy, he was going to proceed". What are we supposed to ask him abt if we know he didnt even try? How come you brought his case? This definitely doesnt follow whatever you're trying to prove. Same thing with USCIS memo. Well... I give up. Hopless case.
 
When I posted my first response, I did not realize yet he did not try. First, I sent him a note, then I responded to the thread, and only then I realized...
I thought you would be able to find out from him that he successfully adjusted his status.
The thought he did not even try struck me immediately afterwards, after I posted my first response.

I just gave you a pointer hoping it would resolve your hesitation, because obviously he could not be denied because of that reason.

Guy A is in US on F1 did eDV as single no kids and wins.
His GF is also here in US on F1 with her minor son C on F2, and C is in fact A's bio son!

After the win A marries B legally and send those details to KCC asking to include both B&C as derivatives.
All send i-485 when correct time comes. They face a not so dumb IO at the intvw with A's KCC file in hand, will 'AoS be ok' for them?

P is here in US on H1 with Q wife and minor son R on H4 s. Q do eDV correctly with only P/R as derivatives and wins.
P realize that his 'other child' T, a minor whose Mom is S, is also in US on F2/F1. (Q or R has had no knowledge of this 'affair' what so ever!)
P do not ask for derivative status for T but include him as bio child in his i-485. [ may be as a case (c) take the instance where P convincing Q to ask KCC for derivative status for T and T has an i 485 too]

A. I do not really understan what exactly he sent to kcc and what for. If it was ds-230, bad luck. If not, what?
 
B. aos is ok for them.

Btw, excuse my grammar, i am on ipad from vacation. Ipad does not allow a lot of capabilities
 
medical exam issue

So guys hi i am really worried about the medical exam because i have Pectus carinatum, also called pigeon chest, is a deformity of the chest characterized by a protrusion of the sternum and ribs.will they disqualify me for these please help i really need a help of a very informed person help
 
Batotr, please start a brand new thread. This discussion is regarding another matter entirely, and you may get a better response if you start a new one of your own, not ask an unrelated question on an old one.
