I originally had an AOS application with a priority date of November 1, 2005 based on my mother's marriage to a US citizen. I filled along with my mother based on being younger then 18 before the marriage (the marriage happened 2 years before she even filled). She had an interview on June 13th, 2006. Around October of 2006 we received a letter that the case had been denied(mother didn't care, she had a bad marriage and left him). That same month I married my wife (as a green card holder), she then became a US citizen the following month. We then applied for adjustment of status at the end of December. I have a priority date on this application of January 10th, 2007.

The question is, having an application that was denied on record, first will that affect my current application at all? And second, In that denial letter they basically said that I have 6 months to appeal the case, or leave the country. Does that translate to a deportation order? Or would they only issue one after 6 months (which I don't care since I married before they would issue one). Can I find out if I have a deportation order on record?

Thank you,

Pip

I'd say your previous denial shouldn't affect your current application unless you entered U.S. without border inspection.

What visa did you use to enter the U.S. by the way?

Hi:

Seems like you were dependent on your mother's K1 - did you arrive on K2? Your case may turn on this fact.

Anyone? By the way we just received our interview notice yesterday in the mail. It's for June 5th. Our notice date is Jan 10th. This is at the Boston DO.

Wear it...

:D

X,

You should be fine and no worries at all. :( Don't forget to wear shorts and slipper when going for the interview.

It is required..................... USCIS officers in boston demand that you wear shorts, because it is good for you health in the summer.

Lastly, did I mention that shorts are required? Oh... required by the weather dude..:D Don't forget to apply for your free greencard boxers...courtesy of USCIS and citizens for welcoming new immigrants...:D
