No, but USCIS is exceptionally unlikely to do anything with the case until they discover the final disposition.

Neither. They are likely to issue an RFE demanding to know the disposition of the court case.

By the way, my attorney call the court again and they still can't find my record. He said when the times come, my attorney can write me a letter and explain the situation and ask me to don't worry about it. But i just don't wanna hear any surprise...

If the court truly doesn't have the records, get them to provide an official letter saying that they don't have the record, and then you can give that to USCIS.
