Hi Guys,

I cant believe I am asking about this again,

does anyone knwo the answer to this

if you are about to be rejected from a non-dual intent visa (E3), does that affect your green card application or interview?

The GC process is not affected by anything except if you commit any kind of immigration fraud or overstay a non-immigrant visa.

The E3 will be denied for sure once you start consular processing because you have shown immigrant intent. However, that shouldn't matter since you will have your GC in hand soon.

As for applying to DV most layers say that it does not interfere with non-immigrant status because its a fairly low probability of success, so its still possible to be a non-immigrant but apply for DV.

it is really funny you say that LucyMO, because i spoke to two lawyers and they both said opposite things, one said you have no chance the other said go for it

but it all sounds like it is up to the interviwer what they decide,

I think it is better to go th GC and then to the E3 if the Gc falls apart for whatever reason

Hi Lucy, could you ask those people you know if they got hassled and which POE they went to....???

I will be sending in my response to first NL for 2008DV in March, and my concern is that my "participation" in DV lotto might mess up getting TN @ Detroit's POE, upon a face-to-face interview with an INS officer.

My question is: Does the INS database show if a person seeking NIV (i.e. TN) has been selected for DV, and as such create an impediment to getting the NIV approved @ POE?

Also, if my DV case # becomes current in Aug-Sep, will there be enough time to get the second letter and jump into the race for Montreal CP processing in Aug?

So responding to First NL involves submitting forms -:
DSP-122 => Supplemental Registration for The Diversity Immig. Visa
DSP-230 => Application for Immig. Visa & Alien Registration (part I & II)

My question is: At what point will "clear dual intent" manifest itself? when I complete & send DSP-230 or when I submitt I-485 @ CP interview?

I think you are misinterpreting what dual intent is. Dual intent visas are H and L. Their holder can have an immigrant or a non-immigrant intent.

All other visas are either intended for immigration only or legal non-immigrant status only.

Once you file DS-230, you show immigrant intent.

I believe I have a good understanding of what "dual intent" means.

I know that filing I-485 voids any NIV's which have dual intent exclusion (i.e. TN visa). I just was not sure if DSP-230 had the same effect, but from your answer, my fears have been confirmed.:mad:
