Does any one want to switch from AOS to CP

i know the number is pretty low
but i am in NY
the case would need at least 7 months to process.

I am wondering if i change it to CP.
when my family get the letter for interview, i fly back and get the interview and get the passport stamp then i fly back to America
is that a possible way?

I am on F-1 visa
 
Why would it be 7 months to be processed? I think NY is like 4 months...but you have to choose, nobody else can do that for you...IMO you should be fine doing AOS and not losing time while you are studying...JMO!:)

But i check the USCIS web site, the process time for NY office is usually 7 months. The national goal is 4 months.

Also i have unauthorized employment record, it may become a bar for me to change of status within US.

What do you think??
 
Hmmm the unathorized employment will be a problem, i suggest you to meet with a lawyer and maybe you will find reasons to prove why you worked that way.

i am on f1 status too and i have applied for cp, but i heard that if i go for cp and go back to my country for the interview, i will have to give up my f1 status. if it is the case wht if i fail in my interview?? will i not be able to travel back to united states then on my f1 status ???

Why do you have to give up your F1 status...till you have your GC?

According to my knowledge, if you fail the interview you can't go back to USA because your F1 status gets canceled. Also, it will be very hard to apply for another F1 visa because you have already applied for an immigrant visa and showed the immigrant intent.
 
Chooti is right, but that reason doesn't change if you do CP or AOS.

The working without permission can be a real issue....it is weird, illegals work all the time and this government might want to give them a way to stay here....but that is not official yet and you have to deal with your case and chances.

Indeed a lawyer might be a good idea. Btw did you work an official job or an "official job on campus, or a job that was paid under the table....
