What kind of documents are required to prove my non-immigrant status when filing I-485? Please respond. People who received RFE on I-485 for status also please respond. Were you successful? Thank you

can you please let me give an insight if there is an RFE on about employment history while in the US, would experience letters and H-1b approval notices suffice the request or do we have to provide W-2, Paystubs since our presence into the US.

According to my Lawyer here are the documents I have sent in my AOS package:

Fillable forms
I-485/765/131/G325a (1 each for me and my wife)

Letter from employer that still employed
2 months Paystubs
2 months Bank Statements
Letter from bank showing your account details and money in it
Last three years W-2
Birth Certificates
6 snaps
Cheques
I-134 (affidavit of support)

According to my paralegal attorney :

Besides the "basic ones" mentioned in I-485 instructions (photoes, medical , forms ...):

- Copy of Tax return, not W-2
- Bank statements, not the letter from Bank
- Letter of employer states you are still an employee, not pay stub


any thoughts ?

Sorry my bad....forgot to add the I-94 and Passport pages.....thought they were the basic ones you HAD to put in there....lol.

Well regarding Tax returns.....I asked my lawyerand he said W2s OR Tax returns would do....if I had both that would be better. I have no tax returns for 2003/04 as i e-filed and have not kept a copy of that return. I have the tax return of 2005 and have sent that.

I was specifically told that you need BANK STATEMENTS and BANK LETTER from some OFFICIAL on an OFFICIAL LETTER HEAD.

Pay stubs were also required. The pay stubs show how you get paid, where does each part of your income go (like savings schemes etc etc.....social security and what not)....but it may not be important. I feel never hurts to give TOO much information.....that way they cannot ask for an RFE.....:-))

Read the I-485 form. They're not required.

They're also not required. I was never asked for paystubs, and never provided any.

I feel never hurts to give TOO much information.....that way they cannot ask for an RFE.....

Too much information can always hurt you; it might give them some other basis to send an RFE about, and it will certainly not prevent one.
 
Okay I never said the paystubs and bank letter are required for th 485.....when I file for my wife as a dependent you have to fill out the I-134 Affidavit of support. That form specifically says you have to attach all documents showing your ability to support her....like Pay Stubs, Bank Account Details and Bank Letter.....so thats why those things were a part of my package. Now which document goes where is upto my lawyer.....I provided him with all he asked. Sorry i dont know much about this.....I was just providing info on what I did.....
