Do Asylees need a EAC

I have a question. I've heard that asylees do not require to renew their employment authorization cards anymore. Is it true?

That is true, No more RTD for Asylees. Go get yourself a non restricted SSC card.

I should just go to SS administration and apply for one? Will they know all about it?

You can utilize your unrestricted SSN and I-94 (which should have your name and the fact that you have indefinite work authorization). You are correct, asylees do not need to renew their EAD cards. Read this for further clarification: http://uscis.gov/graphics/lawsregs/handbook/Asylees031003.pdf

On the other hand, when asylees order an EAD card- I believe CIS is now allowed to issue EADs to asylees for a validity date no less than 5 years.

This is interesting. I renewed my EAD 2 months ago and recieve new one for a term of one year. I'm gonna call Immigration tomorrow and find out.

Another thing. My I 94 card says that I have an asylum status for undefinite period not employment. Could you please explain. Thank you.

I clearly remember seeing a PDF file on the bcis website that EAD should be valid for up to 5 years begining 07/31/2004. It's one of the five or four listed "improvement / Archivement"s by that Aguirre guy telling the congress that the new DHS/INS was actually working. However, so far I haven't seen a single case that an asylee was issued a EAD card valid more than a year.

I hope I am wrong about this as I don't mind to get a 5 year one myself.

Your I-94 should have the following information on it:

Admitted as an Asylee pursuant to section 207 of the I&N Act. If you depart the united states, you will need prior permission from INS to return. Employment Authorized.

Date:___XXXX___ Valid til: __Indefinite___

The words may not be exactly the same, but it should have the INA section #, the fact that you are an asylee (designated class), and that you are authorized to work indefinitely.

There has been a recent memo issued to CIS that allows Immigration Officers to fix incorrect I-94s without us having to fill out a Form I-102 Application for Replacement/Initial Nonimmigrant Arrival/Departure Record. You might want to go to your local CIS office to get your I-94 changed. Check out this link for futher details: http://uscis.gov/graphics/lawsregs/handbook/I94Errors033004.pdf

Hope this helps.

Mine EAD is also valid for 1 year from Nov 2004. I don't know what's about the 5 year validity thing?

Hi Asylee13 -

I managed to track down the document that spoke of the 5 year validity of the EAD cards. Please refer to page 3 (last page) of this document:

http://uscis.gov/graphics/publicaffairs/factsheets/Back_Fact_06_17_04.pdf

Re-reading this, I realize that it was a proposal of something CIS plans on doing but it doesn't seem as though they have started the process. In either case, they will have to if they plan on reducing backlogs by 2006 for most immigration benefits/applications.

Hope this explains it better for you.

For my understanding it's gonna take them forever to do it (as usual).
