This thread has been created for the sole purpose by which new peolpe can ask questions to those who have been around for some time. these discussions can be quite revealing and helpful. so keep an eye out for these.

posting some already known discussions on this thread.

1. I always wanted to tell people was when someone gets approved, please send all congrats via personal messages instead of posting a message for everyone to see. It wastes time for others.

2. One problem I foresee is the spread sheet going into different streams with lost entries. What I can do about that for now is to keep tracking it as owner of this thread and keep it as clean as possible. Please post your information on the thread and I will add it to the spreadsheet and post updated versions every weekend. Some people don't post their info because they don’t have the patience to create an account. if you are one such person please email your details to

We would like the information in the format as
a. EB1/EB2/EB3 - RIR- Concurrent/non-c/Consular processing
b. LIN number first few digits
C. RD and ND
d. info about your 485, EAD and Adv parole applications

3. What’s the difference between RD and ND.

Well, there is not much difference. RD is the receipt date and ND is the Notice date. I think everybody tracks the approvals by notice date. but RD and MD(mailing date) are mostly informational. I think that the ND and RD are available on the receipt notice you will get from BCIS. They don’t have a PD(priority Date) for I-140. The date available on the website is the receipt date.

4. What are these LIN numbers and how to interpret them?

The way these numbers are made is as follows.
LIN-NSC (nebraska service center)
EAC-VSC (vermont)
WAC-CSC (california)
SRC-TSC (texas)

the next two numbers are the year. 03 - stands for 2003.
the three after that is the number of Working days from Oct 1st which is start of that fiscal year.
the next digit is normally 5 or 0. 5 represents available online status.
the next 4 numbers are your case number on that day.

6. Sometimes you get this message on automated status. It seems that it is no big deal. The BCIS service person will tell you to call after 150/180 days(as mentioned in your notice) of your RD if you ask about it.

Status for this Receipt Number cannot be found at this time in this automated system. Please check your case receipt number to see if it is correct. If you have questions or concerns about your case status, please contact the service center where you submitted your application

8. The following message means that AP is approved.

On August 13, 2003, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued.

9. for filing for 140:

For filing I-140, you need the original LC.
You need the following doc's:
1] Company Federal Tax return copies for last one or two years. OR audited financial reports.
2] Your foreign degree evaluation reports.
3] Your previous experience certificates - copies.
4] Transcripts from your degree / PG - copies.
5] Reference letters from experts in field and from peers. (I think these are important if you are going to file it in EB2). These are not required, but good to have them.
6] Current visa approvals (H1 & H4's). I have submitted the copies of I-94; front and back of the passport also, but not required.
7] Employer Support Letter.. Since I-140 is filed on behalf of the employer, my attorney suggested that we file a letter from the employer. All it had was like.. we have a job opening for which we have obtained the LC from DOL, job descr.. salary.. permanent position.. we submit our financial reports.. expecting the approval very soon.. and a brief profile of the company.
8] G-29 or notice of appearance for the attorney. If you are applying for CP, my suggestion is that you submit a G-29 for yourself as well along with another G-29 for your employer. For
I-140 alone, G-29 signed by the employer is sufficient. But for CP.. this is what somebody told me: You can save sometime later on if you submit the G-29 signed by you as well. If not, NVC will need to send you a communication asking you to authorize them to send the Packe-III doc's to your attorney. But, it is just that somebody told me and my attorney agreed with it. So, it is up to you.
9] Of course, the LC and the check or money order. Is it $135.00 ?

10. Educational qualification is done by:
The Educational Equivalency is required for any foreign degree qualifications, as far as I know. Done from "Trust Forte Corpn". they charged me about $ 60.00, I received the certificates in mail in two weeks. You can fax them the degree certificate and the transcripts.

11. Education evaluation:
Many are concerned about the 3-year degree from India and many have posted that BCIS will only accept Single 4 year degree or it should be mentioned on LC that employer would accept combination of degrees.

12. You normally get an RFE as soon as they receive the application if something is missing or later towards the end when they want proof of something. In the latter case, they normally approve it as soon as they get the response.

21. Some RFEs for 140 received are
1. Company’s ability to pay and other tax details.
2. Education evaluation for non US degree holders.
3. RFE for color photos for your EAD & AP applications


13. Conclusions from observing the trends on the 140 movement. it is noticeable that the consular processing and non concurrent filers seems to be getting approved much slower than the concurrent ones. So best thing is to file for 485 along with the 140 and not wait until 140 is done.

14. There is an increasing difference between the processing times for concurrent and non-concurrent processing. Though, once a person files as non concurrent it seems to be remedied by filing the 485. Some employers are not aware that 485 can be filed after the 140. Please make them aware and file it. This is faster for you.

15. If you don’t have experience letters from previous company’s you have worked with..
Get an Experience letter from your friends or supervisor who worked with you in those companies, in their CURRENT company letterhead stating that you worked as XXXXX in YYYYYY company from xx-xx-xxxx to xx-xx-xxxx and your job responsibilities were XXXXxxxxxx. (Make sure that this matches with the skill sets in labor certificate). This letter must show the Name, current Job title of the person who writes this letter.
Sometimes, you can also get some letters from the clients directly rather than from the employer.

16. Sometimes when you as checking the case status online, you will get a message
"
The purpose of the Customer Relationship Interface System is to give customers and their representatives, access to case status information on their applications in our electronic inventory. To ensure that customers have full access to check on their cases, we use several volume limits.
You received this message because you repeatedly entered invalid receipt numbers.”

In such a case, you have either entered a wrong receipt notice too many times (I think 3 successive wrong numbers will block the IP address. if this is the case, then you have to wait 24 hours to try again.) if it wasn’t you, then it is possible that someone using the same IP address, has tried to access a certain number of incorrect status numbers, perhaps by running a scanning program (as you can see if you search the other posts) then this error would show. This can happen when companies map all machines to a single IP address.

18. The difference between EB2 and Eb3 is that
EB3 is for skilled laborers applying for immigration and EB2 is skilled laborers with advanced degrees. If you don’t know what you have filed as, look in the receipt notice.
On the right hand side 4th box down, there is a section for "notice type" and it says receipt notice. There is a amount received. And then there is a "section" that explains whether it is eb2 or eb3.
if it says "Sec 203 (b) (2)" then it is eb2.
if it says "Sec 203 (b) (3)" then it is eb3.

20. Please be courteous to the tracker updater. He/she will post the spreadsheet at regular intervals and not as soon as you post your details. So please be patient.

21. If someone doesn’t know their labor certification statement for what post they were certified, then they can look it up at http://www.flcdatacenter.com/casesearchperm.asp

22. If Kinko’s does not allow you to make color copies of passport and other documents you can do so at office max or Staples.

23. The I-485 portability (AC21) is possible when your 485 petition has been pending for 180 days and your 140 is already approved.

24. The labor certification is valid forever just like the 140. you can decided to file the 485 or 140 whenever you want after that. (Also the job should be "similar" to your old one).

25. Difference between concurrent and non concurrent:
Concurrent filing => Filing I-485 petition, while I-140 petition is pending.
Non-Concurrent filing => Filing I-485 petition, after I-140 petition approval.
semi-concurrent is just a word started by robocop104 in the spreadsheet tracker to know that the 485 was filed after the 140 was filed, but before the approval of the 140, with an intention to expedite the process of 140 approval.

26. you can change from AOS to CP and vise versa.
AOS-CP: by filing for an I-824.
CP-AOS: by filing 485.

I say they might approve all the Aug 12th cases.
 
My guess is that they won't approve today. May be we can expect more I-140 approvals next Friday.

By the way, What is the bet amount?:D

Although they approved a couple in my range,
LIN0324351758 was approved today (ND:Aug 13th 2003 )

I called up National service center, no one answered. I employer has sent a Fax.

Here is a question a scary one ... Is it possible that the Application can be lost... If so what to do about it
 
Folks FYI,
We all will be loosing a day of processing time as Monday is a
federal holiday.

Does anyone know how does USCIS evaluate part-time degree vs. full time degree, since part time degrees generally take longer than the full timers?

My 140 is EB2. I think now they are processing mid aug 2003. So it may take some time for my case.

H1-B cap reached.. so I think I-140 cases will start to move pretty faster from now-on, like it did before this mess.. According to my scan, they are processing Aug 28 cases too..

The cases are getting approved randomly, and I don't understand why they don't follow a good sequential order for approving.. the range of approvals is now between May 26 - Aug 28 .. I am not scanning dates after Aug 28, so don't know if there are approvals after that date too..

Can you post your latest scanner results.

Yes the processing order seems to be a it is a little wierd, may be they allocate a bunch to a worker and the processing order/time depends on his/her efficiency.

I hate to say this , but this is one job I WILL like to see OFFSHORED , I am sure we will get much better results !! :)
 
I-140 Approved

Hello Everyone,

My I-140 got approved this morning! Thank God!!!

RD 8/28/03, EB2, Concurrent. No RFE.

In fact, it got approved in the last hour or so (online status). I checked this morning when I got in to work and it was pending. Now it shows that it was approved on 2/18/04. I am posting the details on the tracker thread.

Thank you all for all the useful info and advice. Special thanks to Naanshi and Dasarihp_newid. GOOD LUCK to all pending cases.
