Hi I need some advice. I am a GCH and would become a citizen at about 2012. I got married and my wife has been out of status, oh since she was 12 years old:). Anyway she was brought here by her parents and has been here since. It is a long story as to why her parents still haven't resolved their case. She would be one of those who would benefit from the DREAM act, if it ever passes. My question is this; should I file an I130 for her now or wait till I become a citizen?
 
Whether you file I-130 now or after becoming US citizen doesn't make much difference... at least for now.
 
The point is that when I become a citizen her overstay is forgiven, could the I130 be denied now that I only have a GC?
