HI, i hope you will help me. one month after the marriage i knew that my husband has to pay to IRS 120.000. he didnt pay for 3-4 years cos as he told me "they made mistakes in his tax returns" so he tried to sue them.he went to court and this is still in process. he made enough income for the last 3 years to be my sponsor to apply for my green card. so what we should do? write an explanation letter and any prove for his income? or find a co sponsor? is it any bad record that he didnt pay taxes so it will cause my paper work? thank you fro any respond

For God's sakes don't even dream of filing jointing with this joker in the future. ... And please tell me he has the $120k to pay them.

i guess he has, cos he told me he is gonna make over 200k next year(he made more last three years) but he told me he is not gonna pay because it was their mistake, his attorney said he would win the case.(i really hesitate). i trust him and ready to help but i dont really understand how it will affect my petition for the green card. his lawyer told that as soon as his income is ok to be my spouse, they dont care about the case b/w IRS and him ....im really desperate about it and dont know who is right.

basically the question is what does the immigration will tell if my husband has enough income to be my spouse but at the same time has a debt to IRS.will they ask for co sponsor? or they ll deny my case ill the time he pays?

Apologies for being blunt, but your husband is an idiot. If he has a dispute with the IRS, he files a return and pays the taxes due that aren't contested. My prediction is that your sex life will become very interesting in the future, as the IRS will kindly provide him with new orifices that he was not naturally endowed with.

Seriously, you two need to talk. Any assets you personally have that ever get transferred into joint ownership will likely be lost forever. Plan on liens, garnishments and the other.

Don't screw around with the IRS. I've had disagreements with them in the past, but I've always made sure to provide good documentation and pay up in places where I was in the wrong.

Is this the same "lawyer" who said he could beat the IRS and didn't need to pay taxes??

Actually, this time I suspect he's right. If he has the income, he can sponsor you, even if IRS is going after him.
 
If you have cash or asset that is over 120K for a couple. You can just show your bank statement for the last 6 month plus certification/valuation of your property asset should be enough to prove your husband is able to support you. The guidelline for cash asset/stock/property is 5 times of the poverty guidelines. See link here for a more detail explaination:

I think wether your husband filing taxes or not has no effect on your application as long as you the applicant filed taxes each year.

and if you wanna make your life easier, don't file taxes jointly with the joker. If you do that, you'll just put yourself into hell.
