Hi everyone, hope someone can help answer my question.

My husband, child and myself came to the US in july to apply for asylum but at the port of entry my husband told the officers that he had helped his cousin in some work so they cancelled his B2 visa and was sending him home.

He told them that he came here to ask for asylum so they detained him and charged him as an arriving alien.

to make a long story short the immigration judge granted him asylum yesterday but the TA reserved the right to appeal.

My question is can ICE release him now of bond or parole and what do you'll think will the TA appeal?

My heart goes out to u and ur family, try to contact any family in the US if possible for help , and find a lawyer in your area ASAP. God be with u

Tecnhically, your asylum grant decision is not final until the period the IJ has given the TA to appeal is over which is normally 30 days. So I am assuming your husband will be held until that period is over.
 
Thank you Mr. Limbo, my husbands mother, brother and sister are citizens here and his brother served in the US Army. We do have a lawyer.

Thank you mesbahul.. thats what our lawyer told us too. just wanted to get a second opinion.
 
Hi everyone, wanted to let you'll know that the TA did not appeal and my husband was released 2 days ago.. I'm so happy.. thank you for your responses.
 
What do we need to do now after the IJ granted us asylum.. paper work etc?

You can make an infopass with the USCIS and request a new I-94 stating your new status. However, it does take some time before the USCIS gets your file from the Immigration Court. I had to wait three months.
 
We received a letter from USCIS stating that they have received a copy of my husbands application and that we need to keep them informed if any address change..

so does that mean that they have received my husbands file?

Most probably they did. That was pretty quick though. I would definately recommend you make an infopass and get a new I-94 stating your new status. This is just to make sure that everything is in the right step. USCIS is very good at screwing up.
 
Today we received fingerprint notification from USCIS and it says case type
I589 Application for Asylum.

I dont understand my husband had his fingerprints done before the hearing then he was granted asylum by the IJ.

Do we have to see an Asylum Officer now?

Im confused to what this is, tried calling the lawyer but he does not answer his cell.

We dont have anything on paper stating that Asylum was granted.... mesbahul, as the IJ granted your case aswell what did you receive?

The IJ would not approve asylum for your husband without good and current biometrics. Bizzare. Contact your lawyer.

That is pretty surprising. Normally, your case will not be approved until your biometrics is cleared. You should make an infopass appointment and take your court decision order with you to find out what is going on. This is very bizarre.

In my case, once I got the decision from the IJ, I waited for 30 days. I called the 1800 number to check if the DHS appealed. Once I found out they did not appeal, I made an infopass appointment. I was told to try back in a couple of months as it takes about 2-3 months to get the file from Immigration Court to USCIS. This is actually in New York City. I went back after a couple of months and I got a new I-94 stating I got asylum granted from IJ on the date I was granted.
 
OK thanks, how do you find out if DHS is appealing?

You should receive a letter from the Court, If you will not get a letter within reasonable time, you should receive approval after the background check will be completed.

Thank you everyone for helping me out.. we went to Immigration today my husband got his new I94 but my daughter and myself did not get it..

We were told that we needed the same approval notice which my husband got with our names on it.. when he submitted the application he put our names in the application..

Our lawyer has not told us anything about what we need to do and he wont answer his phone.. guess he's not going to get anymore money so he wont answer us.. anyways I will call the asylum office tomorrow maybe they can help us.. if anyone knows what we need to do pls let me know..

We went to the asylum Unit and they told us that they could not help us because the IJ granted my husband the Asylum..

Went back to the Immigration Court and they told us only my husband got asylum because he was in proceedings but not us.. Why did the IJ take my daughters and my pictures and asked if we are in the application and if were present at the hearing which I was and he was writing something on another paper..


Im lost can someone please help.
