My wife is a dentist in India. She tried twice to come to US, on F1 and visitor's visa. But her visa was denied, because dentist are not allowed to come to US. I don't understand this new rule. My question is if I declare that I am married to her and want to invite her, will her visa get denied again. Can a green card holder invite his wife or fiancee? If not, what other option do I have? How much time does it take for a green card holder's wife to come to US? Please help ASAP.

I don't think there is a rule like that.

for non-immigrant visas - yes, it will be denied again, since now she would have a GC holder spouse, which pretty much proves immigrant intent.

Can a green card holder invite his wife or fiancee?
on immigrant or non-immigrant visa? please be specific.

If not, what other option do I have?
none.

How much time does it take for a green card holder's wife to come to US?
5-6 years for an immigrant visa, or sooner if you become a citizen.

Sorry, but sorry NO...

Suran,

Sorry to learn that your wife is having a hard time trying to get a visa. In truth, her visa is going to be denied again, even if you claim that she is your wife. Reason: immigration intent will be very high on issues of concern to the US consulate in India. As a greencard holder, you can't file any special visa for your wife in India... :o The US govt want you to freeze alone in bed during this winter, whereas US citizens are allowed the opportunity to bring their wives and fiance(es) to the US... :D enjoy them during this cold weather...

How long have you been a greencard holder? On the day that you become a citizen, you can get the K visa paperwork send to USCIS and get her to the US. In the meantime, you will have to travel to India to drink from her well, because she can't come to the US... Unless she flies to London and both you guys go on vacation twice a year... and do marital duties... :p

There is no rule or law that say dentist can't come to the US, she was misinformed... :)

Sure, but if she qualifies and applies for an H or L visa, her immigrant intent is utterly irrelevant.
