I was trying to clarify as to weather u have GC or not since u have been living for past 10 yrs atleast rt. If not them apply for PCC from indian/Country Embassy [under your jurisdiction ]in USA

Mukul - When r u leaving for Delhi

Even after ur H1 has expired, u can show the H1 Extension filing receipt to Indian consulate in chicago and get ur PCC.
if u r leaving for India, atleast 30 days after ur PCC filing, and u can personally go to indian consulate, u can assert that u r leaving (take air tickets as proof) and u should be able to get the PCC.
Remember it\'s their duty to issue PCC and our right, though being from a different system, we\'ve to accept the whims and fancies of these people...Good Luck...

I am leaving for India on Jan 25 although the interview is on Feb 27. Did not take a single vacation last year. So planning to have lot of relaxation and fun.

PCC - Received from CGNY

Guys ,

Just an update for those guys who have applied in CGNY.

Please follow it up with CGNY At every Stage .

My personal Exp. Applied on 12/12/2001 and they faxed it only on 12/21/2001. Therefore just call them after a week of applying to confirm that they have sent the fax.GET THE DATE OF FAX FROM THEM.
Tell them that you would like to call the RPO in you regional area to follow up your Case.

Next frm the date of Faxing after 3 weeks start pestering them at
the following # : 212 774 0610 or 0662 or 0667 to get your updated status and if they say that they havent recvd it .Follow it up after 4 weeks with E-Mails. This helped in my case as the consular officer had replied back saying that come and collect it after 01/22/02 .So keep emailing them to find the status .This is a Documentary evidence that you have been communicating with the consul off.

Today after a lot of fight with those guys . We were finally issued PCC after waiting the whole afternoon.
I had carried my Email Communication copies with the Receipts.

Thanx a lot for that confirmation. It cleared a lot of confusion! But yesterday I had gone to the city and got a lot of things done -- on of them was to get a PCC from the Indian consulate. I got the PCC on the same day, as my passport was issued here in N.Y. I got it just to be on the safe side - as that is what my lawyer advised.

Also, I got my birth certificate translated to English. Does anyone know if I need two translations?
My lawyer said I needed 2 certified birth certificates. I don\'t know about translation?

wHAT HE MEANS IS THAT U NEED AFFIDAVITS FRM 2 PEOPLE WHO

KNOW YOU AND SAY SO IN THE AFFIDAVIT. CUD BE MOM ,DAD ,UNCLE ANYONE

IF NOT BC PRESENT OR
IF BC PRESENT AND SOME DISCREPANCY THEN
 2 AFFIDAVITS FRM INDIA / HERE WHO KNOWS YOU CLOSELY [FATHER,MOM,SISTERS ,BROTHERS,RELATIVES]

IF BC PRESENT IN OTHER THAN ENGLISH THEN GET A TRANSLATION DONE AT INDIA/USA.

FINALLY HAVE THIS CERTIFIED BY YOUR ATTORNEY OR
IF DONE IN INDIA THEN DO IT IN FRONT OF A MAGISTRATE. THIS CAN BE DONE IN A DAY. NO PROBS. YOU GO TO ANY COURT OURSIDE LOTS OF THESE LAWYERS OUTSIDE THE COURT ,GIVE THEM SOME MONEY AND GET THIS DONE IN HOURS.

u can look i there r any at immihelp or imminfo. check with ur attorney, he\'ll definitely have one..as my attorney Rajiv Khanna had sent me the format with I-140 filing papers itself..

AS, since your name is not on the birth certificate, you definitely need 2 affidavits on Rs. 5 stamp paper. Anyone in India will know what kind of paper I am talking about.
That paper has to be notarized by an attorney in India.
Here are the instructions and the text for the affidavit.

I, (Please indicate Mother’s first and maiden names for mother’s affidavit. For father’s affidavit, please indicate first and last names.) being duly sworn, hereby affirm and state:
