How do you run these numbers?
Can I-140 be filled without Labor Certification
Concern: My Labor is not approved. However my lawyer/employer is telling that they will file I-140 without labor ceritification.
I am 101% sure that I-140 cannot be filled without Labor certification.
Please Please advice, if it is legitimate to file I-140 in below situation.
Lawyer is accepting the rule that I-140 cannot be filled without Labor Certification.
However, reasoning given by lawyer is that I will be ahead in I-140 queue.
According to lawyer only 3 situation can occurr.
1. I-140 may get denied upfront for missing labor ceritification.
2. I-140 will be accepted initial LIN etc number will be given, but at time of adjudication, because of missing labor ceritification, RFE will be sent and hoping that by that time labor will be approved and copy of labor certification will be sent.
3. If labor is not approved by end of 12 weeks time period of responding to RFE then I-140 will be denied. According to lawyer, I-140 denial is not as serious as I-140 rejection. Or may be lawyer is making this story up.
Why employer wants this to be done ?
Here is reason that I can think of:
A. My labor is approved and they want to hide this information with me.
B. Mine is EB-2 category and I asked to file in consular processing.
But they want to file 1 step at a time (I-140 then 2nd step I-485) that way I am bonded labor for longer period of time.
Question: WILL USCIS accept I-140 without Labor Certification ?

Friends, yesterday I got Bio FP notice , but there was no LUD ??? is this normal ??

I filed for I140 and I485 in Dec 2004 under EB2. I got a FP notice for Jan 16th 2005.I was not in a position to go for fingerprinting that day.I gave my fingerprinting on Feb 16th.
My LUD has not changed until now.Could the reason be becuase, I did not give FP on the day I was alloted.
Is there a number I can call to find out if my FP details have been send to USCIS or not.

What application get LUD on FP ?
I got mine first FP on Feb14th 2005 but since then no LUD on my I485 or I140 ?? Any suggestions

Let me share the good news. My I-140 which was applied concurrently in Dec'04 got approved yesterday. It's a long story..
My first I140 under EB2 was denied(ability to pay) last year and I applied MTR. I also started another I140/I485 EB3 category in Dec'04 with an SUB-Labor from the same employer. Recently MTR got denied after 10 months of wait time. After a month I got this second one approved. It is really a big relief for me.
I got EAD in the month of Jan'05 but never recd the FP's? During the first GC process I finished FP's. Is there any link for not receiving the FP notices for the second process? Any ideas?

Exactly same case here.My wife also never recieved FP n otice.We also withdrawn her previous application and she did recieved FP notice for that application.But she never went for that.Again we applied on DEC 30th for her and she did not recieved FP notice for that application.

I am kinda same boat you were ? I had my first application withdrawn in July and never went for FP although I did re'ced FP notice but for new apply application in Dec 04 and did rec'd FP notice in Feb and again got another Bio FP last week, I hope you guys will get your FP soon too.

That would be nice. But why do you think that this would happen? I have given hope on NSC. For some reason I have a feeling that NSC has separate queues for every state and I think they are currently processing November cases (around Nov 15th) for WA. I might be wrong.

I guess my theory that NSC is processing Nov 04 cases has been proved wrong by NSC. So we are back to square one.
OR
May be they have queues per State/Area and Category (EB3 & EB2). They might be processing Nov 04 cases for EB3 and Jan 05 cases for EB2 for Seattle, WA.
Anybody with approvals to prove this theory wrong?

I don't remember the RD exactly, I think its 5 days before 1/27. Is there a place I can look it up?
