Refile for PERM or wait LC

guys please advise if i should refile for PERM my PD is 11/2004 i dont think it made it regional.
I would like to carry my PD and hence would not like to file for a New PERM.

Is there a way to find if my case made to regional i think during Nov-2004 they were shipping every thing to BEC's

My dillema is if i refile it will take 3 months(ad +process) + 6 month(to audit ) to clear so by that time my regular case might be ready.

any suggestion... wondering when i will be out of this GC lafra :confused:
 
Criteria for RIR/TR for remanded LCs

Looks like RIR remanded LCs which are less that Aug 03 2001 can be requested as RIR if the employer has recrutiment data for it.

We have not seen any > Aug 03 2001 remanded who got 45 DL as early as Oct getting approval and based on the above RIR remanded LCs beyond Aug 03 2001 will be processed as any other TR / State (source) and what is the estimate for such applications given that there are 100 of thousands of such applications in Apr 2001. Thanks.

dec 28 2005.Malied on JAN 12 2006.

Thanks for the Congrats! Here are some info about your questions. I did not ask for any screen shot and did not know how to do it. The attorney informed me that they sent reply to the 45 days letter the same day he received it. According to my attorney, DOL allows the TR cases which were filed on or before Aug 03, 2001 to be converted to RIR. So, after my case were remanded as TR (initially filed as RIR), sometime back in last year the attorney requested DOL to convert TR back to RIR. I guess that my case was treated as RIR this time (the certified letter does not tell, will have to check with the attorney), otherwise DOL would have asked for the 6-month recruiting as requested for a TR case. Please keep us posted on how your case was handled. There are a few of us from this thread and the remand thread that have the same situation. I'm interested myself on converting the TR to RIR if filed on or before 8/2/2001. Thanks.

Question on TR filings

What will happen when a TR application that has not been touched since the day it was filed comes up for review? Will they make us go through the whole advertisement+recruitment process? And if they ask us to advertise, what standards are they going to use for certification. I understand that the current rules are more stringent in PERM when compared to the rules when we filed using the old system. Also, pretty much most of the codes are also going to be different if we are to file new advertisement with the State Job Bank. Any views on this from anyone?

Also, does anyone have a list of states and regional centers with what dates they were processing when the applications were shipped to BECs. This might really help us forecast the timeline between various application categories by using this list along with the tracker.

BEC tracker

I dont know if it is just me or if everyone is experiencing this issue. I am unable to find the BEC tracker thread. Does anyone know anything about its whereabouts?

If it is non-RIR, i guess you have to wait longer.

Thanks for the response.My case is RIR and I spoke to my attorney & employer and then haven't received anything from DOL.

Are there any cases around this PD that are still pending?

Was there any RFE at the state or reginol level?
Is everything went smoothly as far as DBEC is concern (like the data entry process, 45 days letter receive/response process etc)

I am just trying to make sense out of the BEC non sense

Job change in 7th year of H1-B

Is job change advisable in the 7th year?

I understand there will be New labor app (PERM) + new priority date. But is 8th, 9th .................. year extension possible till priority date of 2006 becomes current?

Don't you think your career is more important than GC?

How many more months of RIR case are still in DBEC?

Hi folks,

As a NON-RIR applicant, it seems that I need to wait for all the RIRs get approved before the NON-RIRs kick off. I would like to get some ideas on how many more RIR cases are still in DBEC. Thanks in advance....

My PD was 02/02/04 and I received my approval last week. If you did not get any NOF so far, your case might already been approved, pending mailing.

Hi all .. I did make my contribution and i hope you all will too. There are several groups working in different ways and i guess the best thing is to support them all what ever little you can. You never know which one will work and this particular one is deifinitely making a good effort.
