I think they would not sell it if has not been approved, but seems like its been approved as other members during my timeline already received the approval notice.

I hope to get answers, but if you think that my question doesn't fit in this particular thread, you can ask any USNYCUS to remove it.
IF THE EMPLOYER NOTIFIES BEC THAT THE ORIGINAL BENEFICIARY IS NO LONGER EMPLOYED, THE EMPLOYER MAY SUBSTITUTE ANOTHER SIMILARLY QUALIFIED APPLICANT PRIOR TO CERTIFICATION. THE EMPLOYER MAY ALSO SUBSTITUTE AFTER CERT BUT MUST APPLY THROUGH USCIS.

Please tell us how some cases like our from May 02 are having no progress while you guys are doing 09/02. If it is by PD, all older cases should have been analyzed already before the queue moved to 09/02 right?

I think that estimate that we were making before was wrong.....Look at the table below....As the COs have certified about 3000 cases so far, then this certifying queue should be at April, 2001 stage...Even though, cases are being analyzed for 9/02 month but they pile up at CO's table. So i am sure that this certifying queue is still at April 2001 stage... We can ignore those exceptions (i.e some cases certified of july/august-02 and one case of 2003...those may be special cases or some thing else that we dont know)...............

ZB, gp111, Mnhrdc and all other gurus......what's your opinion about it?

GCNoway was no special case...His PD is April End 2002, his case was certified on 17th May (nearly a month ago)

Something is wrong in the queue software. I know for example that my case is in the RIR queue with a PD of May 2002 and It has not been analyzed yet. (Not been pulled from queue).. How can that happen if the cases are being processed by PD?

No reasoning works..

I really don't want to know your designation of your current employment at BEC, BUT if I provide you the case number that I received from my current employer, how complicated is this task if I asked you to check within your area of expertise? I don't want you to get it trouble if its too risky, I know I am not doing it the professional way, but YOU are the best approach to get the smuck out of water. I really don't want to ruin my level of intimacy to my current employer, as any scamper move would turn out to be negative.

Members of this forum are so great in sending me the peices of advice, I surely am greatful to all those members who passed valued comments by taking out their time and responding to my questions.

Thanks for the valuable update.

On the other hand I don't understand why DOL is so secretive which is leading to unnecessary anxiety and despair. It doesn't look like labor certifications are some classified secret :rolleyes: that they have to shroud in secrecy. All they have to do is give updates every 15 days (or a month) on what is going on. I am sure it is not rocket science to do some number crunching OR for the spokesperson to walk by the COs desk to gather an approximate picture of where things are at. The bottom line is that they need not paint an accurate picture of which date's LCs they are processing. All they need to do is give a reasonably picture to some extent.
I think 6 months is more than enough for them to have got a grasp of what they have on their hands so as to start giving some concrete numbers and dates.

Nobody knows how many SWA cases have been opened for processing or when they will get processed. Nor do we know if regional cases and SWA cases are in separate queues or they are in one single queue being processed in FIFO (by PD and not RD) strictly. I appreciate your's and everybody else's updates, thoughts and analysis but what we need is a offcial DOL update. What is the best way of going about having them do this? Should we be writing a petition?

All of us know that software cannot be so buggy that it cannot maintain a simple queue system. I wish we had resonable answers so that we need not scratch our heads wondering what happened to 1000 cases before the latest approval we saw in this forum.

I think every one in this forum is Jinxed. others are getting approvals but not the people in this Forum :eek:
 
Can it be.....

To all the gurus can it be as follows...
Rule : FILO as per BEC. It is impossible to make it strictly go through FIFO. Finally they will make you go through the FIFO only. It may be controlled at the CO level. Here is how.

There is EB2 and EB3.
I gone through the tracker most certified belongs to EB3, only two belong to EB2.
1. Even if they certify the EB3 for 2002 or 2003 it doesn't make any difference for the beneficiary, he has to wait on the line for the next stage because 140 & 485 is at 2001. if your 2001 case is certified late, still you have advantage over the previous approval. so there is no need to go strictly go through the FIFO, instead of sitting idle, they are approving the EB3.

2. I think the EB2 cases certified are special handling cases. If the 2002 and 2003 EB2 cases are certified then it is unjustice because there may be 2001 cases which are not entered in to the system etc., If 2002 & 2003 cases are certified then they will go to the next stage 140 &485 and take advantage as visa numbers are available. So they are waiting for the EB2 oldest cases to be available for certification.

I think ZB etc.. cases belongs to EB2, thats the reason you are saying that you didn't hear any thing from them.

If this analysis is true... Please don't cry that later PD applications are getting certified!!

Time frame from Dallas BEC

Hi,

I would like to know how mcu time still I need to wait for my Labor approval from Dallas BEC, Mine is PD 0ct 2003,45 day leter recived and repiled in Feb,05

Please share your knowledge as I think somebody on this forum who are in the sae boat like me ,has made some research .

Please help get some idea as I seriously thinking of going to PERM.

Can I expect reasaonbly in few months about the final outcome of my case ??

No Offence...
There is No distinction between EB-2 & EB-3 when it comes to Labor Certification Or even processing of Labor Certification. It only comes to picture when you file for I-140.

There is a reason why you have seen more EB3 type LC approvals then Eb2 type. Because there is always More LC of that type in queue then the other ones.

For DOL Processing Officiers / COs, the thing matters are How Complete & accurate the information is.. How well the recruitment is done, Wage offered & qualifications/experience of employee matches with Job requirements.

why only few random approvals ??? ONLY GOD & DOL knows.
